6 ‘The Right of Way.) | TO THE EDITOR OF THE HERALD. New Yorx, July 3, 1865. In your issueof the 29th ult., in an article headed “-Who has the right of the way?” your correspond- ent makes statements at variance with the facts, which are simply these:—My horse and cart were hooked and tied, as the law directs, on the stand assigned me by the Mayor, and with ‘the proval of the firm occupying No. 13 Beekman pe Lars had stood probably half an hour unem- ployed, the cars and other vehicles passing and Yepassing without inconvenience, when @ car stepped ree abreast of my cart. The con- @uctor lea’ is platform attempted to lead my horse ahead to make reom, not for his car, but for ether carts coming up that properly bel the right hand side of the street and not on tl where he proposed to bring them. At thisjuncture 8 policeman (No. 1,750) came along, ordering me to move my horse and cart, and, on my refusal to do it, began to untie to move him, which I forbid. He still persisting I simply took him by the arm and told him to leave the horse alone, as he could not move him—this is the sum total of my vio- lence—when he turned on me, seizing me by the collar with violence enough to wrench off the but- ton, and, Srewire ® is club, would probably have hit me had not the bystanders cried shame. 1 then went with him to the station hanes 4 and after one or two hours’ delay was taken to the Tombs, before Judge Hogan, who, after hearing the police- man’s story, told me to go about my business. Much has been said of late about arbitrary ar- vests. Mr. Editor, what do you call this? The car, by simply stopping an oa sooner, would have Jeft ample room for all bd , and as there were ‘but two carte coming up would not have taken Tt was only a few days my cart stood r- tering, putting oo a load, — @ car coming a near the same place the “driver never broke up or tried to stop until the boom of my cart had passed , through the car, putting my horse in a very un- eomfortable posit ine of my young men is now laid up, and probably maimed for life, by a collision p! fainl chargeable to the manner of put- down alls, switches, and turnouts in our ‘pu lic highways—or do they cease to be such as Soon as 8 company can succeed, either fair or foul, nights or Sunda: a - etting down a track? . Right of inks it a question for the \ lawyers; I think it iF question for common sense and reason. And for my part, in this affair I am willing to leave my cause, or rather our cause—as all draymen are deep); interested—before the bar of public opinion or before a competent jury of our fellow citizens.
