James ¥. allen. —The complaint in this case sets forth that the Dlaintitt were copartners, doing business im this city, ‘nd that on of about the 2ithof March, 1865, they sold’ © the defendant, on his credit, cortaim goods, to the ‘Value of $120 94; that these goods were delivered to the ‘wife of the defendant, and that the defendant refused to y for the same or for any thereof. The answer bo | up Wab rather curious, it denied that the goods were sold on his ‘and also that he had any wife’at all at the tinre of the sate. He admitted that ‘on or about the 29th of September, 1863, the form of a marriage cercmony waa ‘between him and one Julia Aun Farrell, who herself as the witlow of one Jeptha Farrell; but set forth that subsequently he (the defendant) discovered that the said Jeptha Far- rell was still living, and therefore commenced ‘@ ‘suit. for divorce’ in the Supreme Court, which suit 4s now pending; that the divorce auit was commenced before the alleged sale of goods, and ‘that'the said Julia Ann Farrell bed left his house volua- tarily, and no authority to contract ang bills, or incur any liability on his behalf; that the marriage sclemnized betwen him and the said Julia Aun Farrell was bigamous and therefore utterly null and void, and ‘that for these reasois he (the defendant) was in n0 wise responsible or liable to the Plaigtics Tor the goods sold to a -"e not his wife nor his ‘ourt ruled that for the oa of the suit the fact that Julia Ann Farrell had another husband ses could have no weight, a3 no ‘ourt had. decreed that th second marriage was illegal and void. That part of the Suswer was therefore stricken out. The counsel for the plaintitt further contended. that the liability of the de- lant, as husband, was not relieved by the voluntary separation of his wife from him, on the ‘ground'that he had been guilty of cruel conduct, which justified her de- parture from his house, testimony ‘produced showed that the plaintiff and his wife moved in fushionable circles, living in an expensive manner atthe Metropolitan’ Hotel and at Saratoga, and that on or about the 29th of January last a diffeulty occurred ‘Detween them. According to the evidence of a servant in the boarding house where the parties lived Mrs. Allen complained that her husband had come home drunky “Neked her and pulled ont a handful of her hatr,”” and the defendant acknowledged be had ill treated her in the Presence of a policeman. Mrs. Allen left her husband afew days afteron account of this occurrenes, and con- tinued to live apart frqm him thenceforward, “The Judge, on charging the jury, instructed them that the principal pointa they would have to consider were :— First, whether the wife was justified in leaving her hus- band, and second, whether, if she was, the articles pur- wero such as were necessary and suitable to her yank and-condition of life.
