Lapaugh, at the same time, offered the letters in evi- dence, The. letters would be important as tending to rte 4 the accused. Mr. Dittenhoffer objected to the admissibility of the amy in evidence. Tapaugh contended that they were admissible, on tne, around t Mr. Apolant had seen Seydel write, and having seen him write had testified as to his beliof in the genuineness of Seydel’s signature to thoso letters, He also stated that the letter ‘hich bore the signature of u coused, and which addressed to Mra. Schaz- berg, were admitted by Seydel to have been written by him Mr, Dittenhoffer said that the biggest legal joke he wer heard was attempting to prove the handwriting of a nan by @ witriess who sheolntety awore that a letter written by a third person to himself (Mr. Dittenhoffer} wag in the handwriting of the accused. He Alaimed thal it was perfectly safe for Mr. Apolant, at the time he tes- lifled, to state that those letters were written by the risoner, and that only having seen him write once, he was incompetent to Judge of the handwriting, from the fact that two handwritings totally dixsimilar, and having ag nag oy ¢ommon with each other, were actu- ally sworn by this astute judge of handwriting (Apolans) to have been written by the Tn the course of his argument Mr. Dittenhoffer alluded to the case of Mr, Hunter, accused by Mr, Cinco, who absolutely swore that his “namo was ao forgery, and through a long cross-examination insisted that it was a forgery, and stated that after the examination was finished Mr. Cisco came forward and ac- knowledged his mistake, stating that his name was writ- ten by himself. ‘Tho Commiasionor stated that if the testimony were un- supported by any other evidence he might have some doubts about the letters being admissible in evidence, but having other evidence tending to prove the ba ness of Mr. Apolant’s evidence he should rule that the letters were properly admits.ble in evidence, Mr. Apolant was then further examined, but nothing new was elicited from him. Mr. Lapaugh then aa- nounced thatthe ease for the prosecution was closed.
