The arrest Aiea made by the offieers on their own responsibility, because of the interference of the plaintiff in preventing the arrest of Dr. Ingraham. ‘The idea that a public place of business was a “man’s castle” was absurd, and tho police were fully Justified in faking the measures they did to secure the ‘capture of the ‘persons mentioned in the warrant. The plaintiff was a wrongdoer, and rendered himself liable to arrest ; and it would be the height of folly to reward him for his obsti- huey, Mr. Hayes and the witnesses for the plaintiff wore mistaken about arlick being present in Hpruce street, just as th abont his being present on the bench with Justi nbush, They evidently mistook Mr. P, G. out intending to commit defendant, who knew by hout'the affair, swore that he was not there, and the jury could not find a verdiet for theplaintiff without stamping Mr. Charlick as a common perjurer. Mr. Smith, in summing vp the cave for the plaintiff, took the ground that he had made out a clear and womis: takable ense of identity. Five witnesses, ineluding the plainti® himself, had sworn positively thy it Mr. Charlick Was present and ordered the police to arrest the plaimtim, and the jury could not help believing them. ‘The defen: dant waa a wealthy tan, drank rich wines amd drove his carriage; but that was no reaeon why he should Be al- lowed tO trample upon tho rights of one of bie fellow citizens.
