Several persone who witneseed the ocev rrence testified that Lynch was ape & reekies, rate, and that when called upon to check his horses. he paid no attention to the warning, but kept on ia his course across Broadway. After the prisoner's arrest by officer Mvarthar, of the Broadway squad, he stated tat one of bis horses was barcbitwd and somewhat a’smanageable, but the wit nesses seemed to think Lymch had the team under good contrat, and might have stapped had he not been intent on crossing Broadway rega’ -diess of consequences. Below will be found the testimeny of Mr John 8. Young, chief of the detective force, who wituessed the vccurrence Ueroughout:— Jobn 8, Young, being duly sworn, ays:—1 am chief of detective squad of pole; May 31, 1864, 1 was standing ‘on the corner of Broadway and Grand street, when | saw prisoner driving westward at a furious rate through Grand street across Broadway; I at this time saw de- the northwest corner of t onto the crosswalk: five of us were standing together at the above place at the time, we tallooed wit all our might to deceased and the drwver; the boy stepped back, but the deceased in trying to get aboad of the truck was struck by the pole or horses and knocked down, and tho horaes passed over her; she -passed witkout injury the forward wheel; she then Tarned over, and the hind wheel passed over ber body; ‘he prisoner made no eifort to stop bis horses until the ‘trock bad passed at least ten feet beyond deceased, and there was one continced shout all the time; the bicd whee! carried tho body of deceased certainly two feot bo- fore it went over ber; Ihave seen a good deal of reck Jess driving in New York, but I never saw anything be fore to equal this; I think the prisoner could not have seen the deceased, or he would not have recklessly run over her; 1 could see no reason why be could not gee her; the deceased jumpe! one side from the crosswalk to get out of the way of the truck before she was struck; the truck was some ten or twelve feet from me when | first saw it, in the middie of Broadway, there was nothing between me and the truck; the track was going at least at the rate of elx or seven Miles per hour at the time. The testimony being all in, the case was submitted to tho jury, who rendered the following verdict.— That Eliza Dubois, the deceased, came to her death by in)i1 received by being run over by a truck May 31, 1864, al the corner Of Gioctway ang Grand street, saia truck being driven by Owen Lynch. We consider it the result of reckless driving by said Owen Lynch.” On the rendition of the vordict the prisoner was re. quired to give $1,000 bail, to answer any indictment which the Graod jury may find against him. In default of ball Lynch was committed to the Tombs. In his ex. amination Lynch said ‘as forty-five years of age, a Bative of Ireland, a teanister by occupation, and lived at No 33 North First street, Williamsburg. Notwithstand- ing the testimony in relation to the rate of speed at which Lynch was driving, te stated in bis examination that he was going op a slow waik at tue time of the accident.
