Dix, and told him that my client was ready and willing to disclose, under cath, all the knowledge be had in relation to facts connected with recruiting at Lafayette Hall. T also stated that in my interview with Mr, Clapp he had Informed me that he had no knowledge that would implicate any one in the frauds alleged to have been perpetrated there; that the only knowledge he had on the subject he ob- tained from the public prints and public rumors. I offered bail such as should bo perfectly satisfactory; I asked for, a hearing, and expressed my opinion, as bis conpec!, that such hearing would chango tho opinion of General Dix, and result in my client’s discharge—an opinion which I still entertain, The requests were mot granted, To this day neither Mr. Clapp nor hie counser knows of any epecific charge against him; and neither the report to the War Department nor that to thé Hon. Mr. Folger contains such charge. If all the facta stated in the report and in the letter were embodied in, an affidavit, and an application for au order of afrest ap- plied for, predicated thereon, no judge of a State or federad court would grant the ordor. All that is stated by Gen. Dix might be true, and yot Mr. Clapp be entirely ignorant’ of any participation in the frauds, His opinion as to Mr. Clapp’s complicity does not constitute bim guilty, or lay the foundation for arrest, "That frauds were perpetrated on recruits at Lafayette Hall, and in every other section of the country where re. cruiting bas been gotng on, are facts about which there can be no controversy.
