The ‘court room was erowded to overfowing, and score: of persons were obriged to etand out in the baliwaye leading Jo the room where the important decision was te be reo. dered. Anxiety was pictured on every face, and the moat Dreathiess silence pervaded the large assembiage, When the Judge entered the counsel took their places in front of him, aad without any apology he began to read. ‘The counsel for the United States were Messrs. A. oe tbh 0 should thas, applied for a writ of habeas corpus, and ude Ritchie was selected to give his decision as to whether it should or should not be granted. It is stated that the im- prisopment of a relati of bis at Halifax—one Dr. oe Mig ey w y~! Se: = Judge writes a Seka tt beg sen office of the Hon. John H. i, Gray, enunael for the ue and obtai the of one of his clerks to copy bis decision, and the ceal knew well what that sorenraped would be There is a deal of talk about such this on the part of the Judge. Nor ie this all for winch, the Judge is answerabi be it known that the Previous to the rendering oot eis decizion application was made to him for the necessary papers to arrest the prisoners, if he decided in their favor, on the charge of violating the Foreign Enlistment act; but he refused to entertain any such motion. In bis decision—of which I give some of the principal points—tt will be seen that he ignores the Upited States Consul, Mr. Howard, as an officer of the United States government; sels aside the cuthority of the entire provivcial government and its logal advisers, and puts a far different version to the in tentsof this treaty than wes ever intended. As to the point of jurisdiction, he leaves that in doubt. In fact, he doubts @ great many points whieh it was bis duty to make clear Upon the whole, it is a strange and cur:ous rendering of the law. The decision occupied nearly two hours in reading. and was listened to with great attention. It is a curioug docu- ment, aud will attract considerable attention both in the United States and Great Pritain. The Judg: ‘dered the release of the pirates on the following grounds:— 1. Because there was no proper requisition on the authority of the United States of America tor their rendi- tien, wiibout which all subsequent proceedings were of no on the he high seas complained of as con- stituting the offence, the parties are justiciable in this province, aud it is pot, therefore, such an offence under the treaty, committed within the jurisdiction of the United States of America, as would entitle the United 5 government to require their being delivered up. Becanee, as at present advised, the Judge thought wait it was an offence for which the prisoners,on & proper cxse against them, should be given up, Mr. Gil- bert ded bo. Juriedietion, neg Nice wangiatrate or as justice of tbe peace, 10 take ce of the matter, but that the proceedings ‘ander the Governor's warrant should bave been before an officer having jurisdiction over the offence of Pirsey. 4. Because, if Mr. Gilbert had such furiediction, the warrant he issued for the commitment of the prisoners, under which they are now detained, is bad om its face, and insufficient io law to warrant their detention. The Judge was of the opivion that, the enactment bav- ing reference to cases of piracy being a statutory one, the requisition could only legally made by the fovernment of the | United States. A public minister might have boriky to make the Reseiee; Di he was pot aware that a consal bad. In reference to the commitment, the Judge felt ‘ata loss to conceive the reason for stating that the of. fevee was o-mmitted within the jurisdiction of the United ‘States; it was not so stated either io the requisition or io the deposit’ons. The police magistrate, he contended, should heve acted strictly in accordance with the terms Of the Governor's warrant, and not = reared m new complaint containing fresh chat an —, ‘been made to him (the Judge) of the prisoners Getained under ibis warrant, he did not see how it could have “successfully resisted.
