The affray took place in a Centre street saloon, where Fleming wapomployed as barkeeper. The two men had a few words, and Fleming put Burke out on the sidewalk. Ina short time Burke returned, and on Fleming again attempt- ing to pnt him out, he drew a knife and stabbed him seve- ral times, and left the knife sticking in Fleming's body. Tho injuries inflicted were of a serious nature. and from a few words uttered by Burke when he entered the barroom for the second time, it appears to have been his intention Police Intelligence. THE SHOOTING OF MR. WALLIS—IS CONDITION. Mr. Charles Wallis, the man who was shot in the face early on Sunday morning by a burglar, who had forced an entrance to his dwelling, corner Fifth avenue and Forty- ‘fifth street, as reported in yesterday's Imnatp, was alive and apparently quite comfortable yesterday afternoon. The attending surgeon bas been unable to locate the bullet, which piorced the victim’s face on the right side of the nose, and lies embedded inthe mouth or head. Hopes are entertained that Mr. Wallis may recover, but he is regarded ag being in an extremely critical con- dition. Should inflammation ensue from the wound the consequences are greatly to be fesred. A year or more elapsed, and the accused was once more deprived of his liberty, on the old charge of homicide. The District Attorney signified his intention to try the case Juring the present term of the Oyer sod Terminer, and the case was set down for yos- terdny accordingly. Knapp. Nathan Worle; In opening the case for the prosecution the District Attorney stated that he would refrain from enter- ing into the details of the case, preferring ratber that the jury should hear them from the Jipe of the witnesses. In his opinion the case was one of manslaughter in the third degree, but if the jury thonght fit to bring in a verdict of manslaughter in the fourth degree, the prosecution would also be satisfied. Policeman Sheehan, one of the principal witucsses, was dead; but there were three important witnesses yet alive, namely:—Jacob L Smith, member of Assembly; Josiah W. Brown, ex-Alderman, and Dr. Nichter, who witnessed the occurrefce, and would state all they knew concerning the case. TESTIMONY. Jacob L. Smith, member of Assembly, deposed as follows—I reside at 20 State street; I know the accused, John B.
