Court of General Sessions. Before Judge Rustell. THE WALTON-MATHRWS MURDER—APPLICATION DISCHARGK (UAKLES JBFFERDS. Serr 20.—Immodiately on the opening of the court, Merers Brady and Hall, counsel for Charles Jefferds, who is now condned ja the Tombs charged with the mur der of John Walton and John W. Mathews, appeared to move for a writ of habeas corpus. The prisoucr was ia attendance, and the spectators evinced much interest ia the proceedings. Mr. Hall submitted a petition of the accused for a writ of habeas corpus, which ses forth, mong other things, that he wes not committed to prisou by virtue of any proper tribunal, but by reason of a preju- diced verdict of a coroner's jury, the Grand Jury not having acted in the matter. Mr. Hall addressed the Court wt length, and read a dumber of aililavits, their purport being tbat the testimony produced against the defendant was insufficient to hold him; that the Coroner, instead of coliecting the jury from the citizens in the neighborbood where the occurrence took place, selected men who were friends of the deceased men who were charged to have been murdered. Mauy of the jurors were personal friends of the deceased, who were very uch ombittered against the prisoner in consequence of family difficulties that bad been brought before the courts. The motion of Mr Hall to liberate Jefferds on bail was denied by the City Judge. Mi Brany’ then addressed the Court, arguing that the prisoner should be discharged at once, for the statute clearly jrovided that if two terms of the court elapsed before an accused party was indited, he should be enti- ted to his discharge; besides, the evidence of the wituess- es for the prosecution was sent to the District Attorney on the 18ib o: July, and that officer had not submitted the case to the Grand Jury. The counsel claimed that the prosecuting officer had clearly violated the statute, which provided tha: every person accused of crime should havo a speedy trial, and intimated that unless the Grand Jury found « bill against Jeflerds very speedily, action would be taken against the authorities for false imprisonment. Judge Kussell stated that as the Grand Jury would bring the labors of the present term to a ciose ou Friday, they would have no time to consider the case this mouth. His Honor intimated that it would be better for the de fendaut to wait till the Grand Jury was empannelled in October. Sedgwick, in the absence of District Attorney Waterbury, said ho was not pre- pared to reply to the application of the counsel for the defendant, inasmuch as he did uot know what the Dis- trict Atiorney meant to do. An intimation having beea given that the District Attorney would be preseat oa nn was brought to a close, tae coun t giving notice that the motion would on Mouday ALLEGED ASSAULT WITH INTENT TO KILL AN OYSTER SALOON REKPER. The only jury trial of special iuterest was a charge of ious assault made by John Saarcke, keeper of an on at the corner of Teath avenue and Tnirty- against a young man named Christopber Cox. TO Cox and a friend went into the saloon of the complainant and ced for oyster stews, which were furnished. Cox asked for some butter and other condiments, which were furnished, but Cox défhanded more abundant supply, when Saarcke observed, * Do you ‘think | can give you bulf« pound of butter in your stew?’? “No,”’ replied Cox, but L want a quarter.” The keeper ‘of the saloon said, * You can’: have any more,” and tol of inso- lowed up this remark with othe lence.
