The Chillicothe branch of the State Bank of Ohio sent $50,000 in commercial bills to Ludlow, cashier of the Ohio Life & Trust Company Bank at New York, for collection. Lud- low, instead of holding the paper till maturity, as was his duty, sold it and used the proceeds. Be- fore the bills fell due the Trust Company iniled, and subsequently the holders of the paper, who bought it from Ludlow, sued the Chillicothe Bank, as endorser, the makers of the bills having been enjoined by the Ohio bank from paying the same. The bills were endorsed by the Cashier of the Chillicothe Bank, ‘Credit my account—J. B. Scott, Cashier.” This the court decided was suflicieat notice to third parties that Ludlow had no authori- ty to negotiate the paper, and upon this ground the plaintiffs were nonsuited. Had it been en- dorsed in the usnal way, as negotiable paper, the defendants would have lost their case. Mr. Scott's caution, in this particular, saved his bank $50,000, and the establishment of the principle may pre- vent, in the future, a great deal of raseality Jar to that practised by the bold and reckless Ludlow. Thisis a favorable statement, and comiirms the views expreseed it, our issue of this morning. The banks begin the week with about $23,500,000 in their vaults, the California remittance of Thursday being sufficient to counteract the effect of Satur- day's shipments.
