A, Rotker & Oo. vs. The Great Western Insurance Compa- ny.—This was an action to recover on a policy of insu- rance, for the loss of a cargo of coffee shipped from Port ‘au Prinoo on board the brig Dolafield, which veescl was lost. It was an open policy, and insured in terms: (A. Roker & Oo., on account of whom it may concern, for outward shipments and homeward, to be for account of themeviyes, and to be consigned to them by invoice and bill of lading.” All except the words “on account of whom it may concern” was written in. Ii was also written in the policy that outward shipments were 10 be approved by the underwriters, and tadorsedt on the policy, and that homeward shipments’ wore to be reported wo th company as soon as known. This shipment was mule some twenty days before the date of the policy, and was roported to the company after the policy, and in duo time after the plaints were advised of it. The defendants refused to indorso it or to enter it in tho pass-book, and they took no premium especially on account of this rink.
