Habeas Corpus for a Prisoner. SUPREME COURT—CHAMBERS, Before Hon. Judge Clerke. Dec. 14.—In the matter of George Werner.—Tho poti- tioner in this case was sentenced to the penitentiary on Saturday last, for six months, for ke@ping a disorderly house. A writ of error having been allowed by Judge Clerke, the prisoner was bronght up this morning, when Mr. J.B. Phillips moved that Werner might be admitted to bail until the decision of the General Term of the Su- preme Court on the writ of error should be obtained: Mr. Sedgwick, Assistant District Attorney, opposed the application, on the grounds that the bill of exceptions had not been settled in the case, and that this Court had no- thing before it on which to determine whether it would be a proper exercise of discretion to admit the prisoner to bail, the execution of the sentence having been com- menced. Jddge Clerke concurred {with Mr. Sedgwick, and re- manded the prisoner withou! i wo the renewal of his application when the bill of exceptions shall bo sottled.
