Wilham Redmond aad Mussrs. L. Von Hoffman & Oo. to the Compt-oller of the State for the vale of the New York and Erie Railroad has been the mcans of awakening the managers of that company. The matter was in the haxds of the Attorney General, and be was about proceeoing to aivertiee the roa. for ale, pursuant to the eleventh section of the act of 1849, when Mr, Recever Marsh appears in the public prints and potifes the holders of first mortgage bonds tpat the interest due on tha first day of May and on the first day of Novemner last wil! he paid on and after the third day of December. H> ‘was undoubwedly driven to wis payment on account of the fear that the Attorney General was on the point of ‘advertising the road for gale. These bonds are vow known as tho first mortgage Dopds. An agent was eppoluted by the company, ap- proved by the Governor wo ni the sale of them, and be succeeded in disposing of a large amount of them ‘tm London and Ameterdam The game act of 1645 which released the compavy from the payment of the ban mule to i; by the Stave, aud which anthorized the issue of throe millions of wwck by the company, contains this sectiva, Vin fee. 6. Tavs i appears that a person holding @ boad of only ope thot dollars—for this stock was issued in one thousane doilar parcels—can compel the Comptroiler to sell the entire road, or a portion of its appurtenances, to satiely principal and interest, or interest alone, if the company fails to promptly meet those obligations. Tho first mortgage bondholders ovly possess this right; those of the second, third or fourth class do not enjoy that pri vilege. Unoer the circumstances, we think the Grst creoitors have been very liberal and lenient in waitiag thus long. It seems thst two semi-annual interest pay- mens due on the Ist of November imst. Applica- von for the rale of the row! could have beea made eix montbs since, but it was withheld, undoubtedly under Promise of payment from time to time. The large suns squandered, such a8 twenty-five thousand doliars salary to ite presionnt, apd proportionate sums to inferior em- ploy és, absorbed immenge amounts of its earnings. The Jersey City long dock, the Bergen tunuel, are also two mammoth expenditures, absorbing every dotlar of sur- pis earnings, I other means are obtained to complete there works, and the enormous salaries to officers and employ és curtailed to proper aud reasonable dimensions, and a more etrict economy observed on the entire line, from the Hucson river to Lake Erie, then it is possible that the read may be relieved from a portion of ita om barrasements, and semi-annual interest be promptly paid w the hoiders of its large amount of outstanding habilt ties. The defence was overruled in all the cases, and the Court decided that the various acta of the Legiala ture authorized the issue of bonds in every case—that the donde were legally issued, and that the plaintiff was en- titled to recover. The Pittsburg Most of the 24th suys:— Judge Grier charged the Jory in substance, that this suit was brought on coupons given for railroad subsenp- ons. The Supreme Courtof the State has assumed the constitutions) vaitdity of such subscriptions, aud that question is not one open for discussion. It is not for courts to inquire whether the subscriptions Wore wise or unwise, but to enforco the law and main- tain the inviolability of contracts. Whatever regret there migbt be ut the amount of debt that had been imposed upon the community for railroads, it is too late now to setup objectious that ought tw bave been made before the bonas were issued and had gone into tho hands of imnocent holders, who had advanced the money to carry on the work. ‘The objections made in this case toa recovery were ably argued and overruled. A verdict was given for the plaipuffs for the amonnt of the coupons that bave been given, and interest on the coupons from tne time they wore payable until the present time. ‘The St. Louis Democrat of the 24 says:— ‘The exchange market ie tight; the supply on the Enst and South is by no means equal to the demand. Some institutions have sold s0 largely the pest week that tuey are short and have to hold up a while; and even regular customers cannot obtain it easily in so large amounts as are needed. For a month yet, or up to the 20th of De- cember, large sums will be needed to pay interest on our public indebtedness East, as well as upon the principal of maturing bonds, Sight exehange on the South is in more demand to-day, both for purchasing groceries and in making Eastern e: change, most of being absorbed in the lator way; though, ax will have been seen, a sudden decline ovonrred @t New Orleans in Eastern exchange, the last investments being only 34 ciscount. ‘The New Orleans Picayune of November 24 says:— ‘The exchange market bas oxbibited but little variation on our previons report. Sterting Dilis aad sight checks appear to be in request, ana drawers contnue very firm. Transactions in the above deecriptions today included some round amounts at yesterday’s figures, and there was LO noticeable increase in the demand for ay other classes.
