‘The Alleged Market Frauds. Yesterday, Col. Before Hon. Judge Russell. Nov. 25.—At the opening of the Court this morning Samoel Sprince, who was convicted last week of receiv- img stolen goods, but who was permitted to go on bail till @ motion for a new trial was argued, was placed at the Dar. Counsel for the prisoner maintained that the verdict of the jury was incorrect, and was not justified by the evidence, ‘The City Judge said that the question before the Court was not whether the verdict given in that case was such ‘as we should ourselves have given. Courts should rarely take it upon themselves to decide on the effect of evi- dence, for were they 80 to act they might with truth be ebarged with usurping the privileges of the jury. Sprince was then remanded to the City Prison for sen- tence. Ellen McNair, a servant girl, against whom were five indictments for stealing the property of her em- loyers, plea leted uty togrand larceny, and was sent to the penitentiary for twe years. Wm. Mulloy. guilty of petit larceny, was sent to Black- well’s Island for three months. ‘As soon as the prisoners were disposed of Charles Moore, who was jointly indicted with two young men named Thompson and Fox, was placed on trial charged with the murder of Danial Stackpole, at the River House in Harlem, on the 18th of November. 1858. On the ‘2th of February of this yeer, Abraham D. Thompson was tried for the murder of Stockpole, before the Recorder, and was convicted of manslaughter in the third dogree. He was sentenced to oh in the State prison for three years and six months. Mr. James T. Brady ap- peared as mening for Moore. a7 ‘was empannelied in ‘a short time and the trial proceeded with great expedi. tion, Mr. Brady having made the following admission in order to save consumption of time in taking trrelevant ‘testimony :—Counsel for the defence admits that Daniel ‘Stack came to his death on the 18th of November, 1858 (Thanksgiving day last year), near the River House at Harlem, by a wound inflict ith a sharp instrument, which wound is correctly described by Dr. Donaghe, on the occasion of a visit to the River House by the Fox Mus- keteers (a target company), in which Moore, the accused, iw a private. The witnesses for the prosecution told substantially the same story, which was, that in the afternoon of the occurrence, Moore went into the bar room and asked Coleman if He was going to march home with the company, to which he replied ‘I will not;” they then ‘went out on the front stoop, when Moore struck Coleman, who attempted to strike him; Moore returned and charged Stackpole with striking him, whereupon he (Stackpole) said, “Ge away from me; I don’t want to have anything ‘at all to say to you;”” Moore subsequently took upa sword, and when Stackpole gaw this he ran out into the yard, followed by Moore; they crossed the railroad track, went into the swamp, and ran up the bank, at which time Stack: pole was stabbed in the back by Moore with a sword, fol- lowed by a stab from Thompson, who had a bayonet; Stackpole fell, and ore out, “O, my God ! Iam murder- ed;”? he was carried back to the River House, and imme- diately removed to the station house, and ten minutes af- terwards died in a chair. A number of witnesses were examined for the defence, ‘but the main facts of the case for the prosecution were not altered, except that it was shown that Stackpole as- saulted Moore witha club. The court adjourned at four o'clock till this (Saturday) morning, when the summing up will take place, and the Judge will charge the jary. THE RIVBR HOUSE TRAGEDY—CHARLES MOORE ACQUITTED. Nov. 26—When the €ourt was opened the trial of Charles Moore, indicted for killing Daniel Stackpole, at Harlem, was continued. The prosecuting officer called a number of witnesses, chiefly residents of the First ward, to rebut the evidence of good character which the de- ence introduced yesterday. They testified that Moore ie yhting character, and had been engaged in riots. Be Rady addressed the jury on behalf of Moore, and * preeditee to say that he made a logical and eloquent argument on the facts of the case. Mr. Sedgwick replied for the prosecution in a clear and succint manner; after which Judge Russell proceeded to deliver his charge, fir reading to Shem anynopais of the leading points of ie evidence of all the witnesses, and then laying down the law of homicide in itsdifferent grades. Obituary. ‘The Omaha City (Nebraska) Republican of tho 16th inst. says:—We have been pained to hear of the death of the Hon. Fenner Feravsox, which occurred on Friday evening last, at his residence in’ Bellevue. He was ill buta few days. The immediate cause of his death was paralysis. ‘The news of his decease will be received with sincere re- gret by the people of the Territory. He was one of its most prominent citizens, and one of its earliest settlers. Judge Ferguson was, we believe, a native of the State of ‘New York. In early life he removed to Michigan and set- tled in the town of ‘Aibion, in the practice of his profes- sion. Whilea resident there he was chosen to the Legis- lature for one term. In 1854, upon the passage of the Nebraska bill, he received from President Pierce the ap- pointment of” Chief Justice of Nebraska, and removed thither with his family in the autumn of that year, locat- ing at Bellevue. He discharged the duties of Judge with ability and impartiality and to the satisfaction generally of the people of his district.
