You were asked, on your re-cross.examination, to atate if you had not every reason to suppose that Capt. Chauncey wrote his leter Nov. 30, 1857, aud made bis strictures on Mary in reply to your letter of the 23th November. Noue other than that I have already siven. if The counsel for the prosecution here annonnoed that he had no questions to ask the witaess, and rested the case. ‘The counsel tor the defence stated that he was desirous of putting in evidence as to the ealary of Captain Chauncey. Counsel for the defence admitted that the salary of a post captain was $2,500 per year wailo off duty, aad $3,600 per year when at sea, But Captain Chavnsey may have a very large income, probably several thousand dol. lars @ year, besides his salary. Counsel for the defence—With that admiagion, we will Fest our case and move for a dismissal of the complaint. ‘Justice Welsh—I will adjourn tho case until Wednesday, June 1, when I will hear auy argument the counsel may wish to make. ‘The matter was, therefore, adjourned until the time Btated, Supreme Court. Tumspay, May 24—6 P. M. Exchange on Europe continues steady, though dull. The business transacted today has been, for sixty day bills ‘wt 110 for sterling and 5.10 for francs; for sight bills, 1105; for sterling and 6.73¢ for francs. A fow bilis have been sold above these rates, but very few. There have been some changes in the orders fer the shipment of specie by the Persia; but, on the whole, we presume that the ship ment will range from $2,800,000 to $3,000,000. All the importers, or nearly #0, are shipping, and tho leading drawers ship between them $1,160,000, Money 's without change; the banks are asking six and seven, but borrow- ers are scarce. The prevailing opinion among financial men is that this will be the heaviest week of the specie shipments. In the fall, when we are shipping both bread- stuffs and cotton, it may be fairly expected that our gold will come back to us. Europe will need our grain and our cotton much more than our bullion. Two failures are announced to-day—Meyer & Stucken, wankers, and Hargous Brothers, merchants of Souun street. Tho former house has deomod it pradent, in view of the late judgment in the case of Graham va. Meyer, to make an assignment; nothing has transpired with regard to their assets and liabilities. Morars. Hargous have beeu compelled to suspend by the failure of the Louisiana Tehuantepeo Company to romit means w cover thelr drafts, From all that wo can learn, if the Now Orleans gentlemen protect their own drafts, as they are bound im law and im bonor to do, tho old and highly respectod house of Hargous Brothers + ill shortly be onabied to re- sumo. Their own liabilities are nowinal, and their iadi- vidual creditors are understood to be secured. Their troubles have arieen eolely from their connection with the Tehuantepec Company. We hear that aid was this morn- ing offered by a leading bank president to W. P. Hargous, who, however, with yery houorable feeling, declined it. ‘The Mexican firm is not involved in this disaster, and ‘will not suspend. ‘The stock market continues dull and inanimate, though a8 & general rule prices are somewhat botter than yester- day. The lato depression in State stocks lod, this morn- ing, to some orders for investment. Tho domand for Tepnessees and Miszouris was quite active at an advance, ‘There was very little done in bonds; Illinois bonds are again lower, The most active stock among the railroads was Chicago and Rock Island, which worked tn favor of the bears, the price receding at the first board to 62, and closing at 615¢ bid in the afternoon. The sellers of thia stock have suffered 90 severely of late that a slight re- action is due to them. The Michigan shares were very quiet; Southern preferred is a shade better; the Central is not quite so strong. These roads, we are happy to learn, have agreed upon remunerative rates for business going East; as goon as Mr. Rishmond and Mr, Thomson agree to end their dispute, the Wostern fares will likewise be raised, Now York Central opened rather better to-day. At the first board the price was 7244; at the second tho stock sold at 71%, and closed at 72 bid. A corres. pondence is still going on between the friends of the four roads, aud hopes are entertained that the absolute neces: sity of ending the present foolish competition will pro- gently occur to the managers. The official report of the April earnings of the Centra! bas been published, and is as follows :— April, 1868 i + $668,424 73 ‘April, 186. . 486,697 40 DAOOUNMD cisspsaseunheossesesenrnrs sseessB181,127 33 The statement to which we aliuded yesterday, and which showed a falling off equal to $226,000, was appa- rently fabricated for stock jobbing purposes. Coal stocks are steady. The Cumberland Company have advices that the Chesapeake Canal is again in order, aud that boats are plying on it. The judgment in Maryland, of which we give a memorandum elsewhere, foreshadows a satisfac- tory issue to the litigation in which this concera is now involved. Bank shares are in demand. Panama was stronger, in consequence of rumors that the embar- regsments of Messrs. Hargous would interfere wiih the Tehuantepec route. Paciflc Mail was rather higher, on the report. In tho afternoon the mar- ket was unsettled, an uneasy feeling prevail- ing. Ovttits and supplice Stock of the compapy on band Due by the United States gove: 8,681,000 00 $1,302,002 46 ‘The report very strangely says not a word about the business of the past year. Brief as it is, it alludes to the projects of the company and to the Vanderbilt oppesition 80 mysteriously as to convey no information atall to stockbolders. It is evident that people who buy Pacific Mail stock must make up their minds to preserve unques- tioning faith in the managers. The following decision of Judge Perry, of Maryland, in the case of the Cumberland Coal Company vs. Sherman and others, is of interest to ail directors and stockholders in incorporated companies :— “The questions to be determined are, whether Sherman could, while acting as a director, purchase the land oon- veyed by the deed of the 224 April, 1866, and now in vis pute, and whether there exists such a state of tacts aa to make op equitable title in the ‘Hoffman Steam Coal Vom. pany” by ratification, acquieacenuce or a purchaso by that Company without notice, &c., and by whicn tuis ourt oan pass a decree affecting the righte or title of Dean to tue iands in controversy.” The Judge decides—first, that Sherman, as Director of the Cumberland Coal and Iron Company’, a8 one of the Executive Committce, as the party employed to make the sale, could not bay it for himself. Second, that Dean, from bis age—twenty-three or twenty: four yeart—from hisfoccupation as bookkeeper, at a sala- ry just euflicient for his ordiary exponees, and’ from hia sckpowledged want of pecuniary responsibility, could not bave purchased bis interest in good faith for himaelf, but simply acted as the instrument of others.) And moreover, (uat, knowing Sherman’s position as director, he was af fectéd with notice Of the invalidity of the traasaciiou; aud third, that as they (Sherman and Dean) created the ofl. cers and directors of the Hoffman Steam Coal Company, (vat thig company was put into existence by them and tbat as they were the stockhoiders, it was alfected with notice, and cannot claim to be an innooent purchaser. For the reasons wesigned it is decided that the complainant is entitied to relief upon the Dill and testimony, baving shown itself prima facie entitled to a decree.
