The report of the affair previously published ‘was ipaccurate, as far as the origin of the «Mfficul:y was concerned. Joyce bad no idea of searing AST, for the reaton that he haa a wife liviig. The story of joalousy ard revenge, therefore, ts groundless, and without any foundation in fact, The testimony taken yesterday was very brief, but to the pou Barbara Convolly, rays! ing at 61 Cherry street, being sworn, eaye:—The prigottr, the deceased, the prigonor’s wife sud mother, were in tho room of the prisoner, No. 24 Cherry sireet; a dispute arose between tho deceased and the prigoner’s wotber; harsh words passed between them, when the deceased arose from hor seat and took hold of the prisoner’s mother; at this moment the prison- er got up from bis seat and stabbed the deceased with a pair of shears; I took hold of tho prisoner and said “Joyce, that is enough, don’t do any more;’’ the deceased fell back upon the floor, and from there ehe was carried to the New York Hoepital. Iniia Joyce, realding at No. 2¢ Cherry street, being duly sworb, 8ays:—The prieoner is my son: deceased ani my- self wore quarreling at the above house; she called me out of pame, and tore the ekirt of my dress; she then took hold of my arm with her teeth and bit me se- verely; I called to my gon for assistance, and he rose from his bench, tock the shears and stabbed deceased; tbe prisoner had the shears in his band previous to the stablang; he was rkinning eels with the sama. Thomas Welsh of the Fourth precinct police, deposed follows:—I was patroliing my beat on the ovening of May Sth, woen I wag called to thé house No, 24 Cherry street I proceeded up ttairs in company with officer Teinpicton saw deceased lying cn the floor bieoding from her woands, the prisoner handed me the shoara aud said “this is wha I done it with,’? at the same iime remarking to me that he was cleaving or preparing some eos with the shears; I re- cognise he theara now ehowa mo, as the same handed me by we prisoner, George A. Quimby, At. D., boure surgeon of the Now York Hospital, testified that deccaved was attended by him, and that her ‘oath was caused by peritonitis, tue re sult of wouncs in the chest and abdom: ‘The case was thon aie n to tho jury, who rondegad the following verdict:— That the deceased came to hePbath by wounds inflicted wih a pair of large acigaors in tho leit side of the cbeet and abdonon; that said wounds were wflicted by Jobn Joyce on May 5, 1859. Upon tho rendition of the ‘above verdic: Coroner O'Keefe proceeded to examine the prisoner ia the usual manner prereribed by law, Joyoo stated thy years of age, was a native of frelant, aud w occupation, rior be est Ho was ZL a talior by Ju reference to the charge preforre AT wos orawakedto «hy mie tr moiber”” The preaace # Action for Libel, THE COUNT JOANNES AND THE SUNDAY PRESS—LET- TERS FROM LOUIS NAPOLEON. SUPREME COURT—SPRCIAL THKM, Before Hon. Judge Sutherland, somewhat kvown 4s an actor and dramatic lecturer, and bas made @ little etir in the community of late. The de- fendauts are proprietors aud editors of a Sunday news- Paper publisbed in this city, "ne complaint is charac: teriatic, and reminds us of the multifarious professions of Caleb Quotem. The plaintiff alleges that be is by profes. sion an histo ian, biographer and author generally, public lecturer and writer upon the highest works of dramatic , and upon the Scriptures, sciouce, natural bia iierature abd the fine arts. ‘The Count comprains nag the defendants published a malicious libel concerniog him, the natural effect of which is to render him unwor- thy 0° any public employment, or any oflice of trust or emolument, or of public support in ‘his professions and honorable avocations; and ais placing him in the poi tion of an enforced the French empire—thus of america, of his hoerty it yof action; and also making hatred and private hatred, assault, r ge OF IDBult from aby native of the brave’ French’ na. tion. Plaiutiff claims $20,000 damages. In eupport of his cbaracter, the Count introduces letter from Napoleon III. One dated Paris, May 24, 1849, auys:— Tho remembrances that you invoke in offering you volumes to the Presidext of tho French republic, you wishes for his prosperity and for the giory of Franc» ve sensibly affected him, and they ensbie bim better t> appreciate the homago of your writings, wherein your acknowledged talent alone gives them a powerful interest Paack or THe ToiLERus, Jan. 22, 1853. Monsigvr 1k Contr Joaxnes:—Your baving accompacied me several miles when I quitted New York in 1837, to at tend the dying moments of the Queen Hortense, is a proof of sympaiby Which I cannot forget. Since the ‘revolution of 1848, in each grave circumstance of State you have given mea testimony of yoar sentiments; while to day again, upon election to empire. you address to me your wishes and your felicitations. I receive them with pleasure, as the expression of a devotedness upon which Tam happy to depend, and I thank you. NAPOLEON, To the Count Joayxxs, Lonton. ‘The complaint further states that the character of the Oovnt has been maliciously assailed and injured by ihe defendants, and submits sutograph letters from the King ot Prussia, and from his Excel'eacy Heory Wheaton, for meriy American Ambaseador at Berlin; and proceeds at great length to ehow that Count Joannes is a man not to be ibelled with impunity, The presett motion is to compel the plaintiff to give se curity for costs. Counsel ov the part of the defeadants submitted that the piaintit!, having a title of nobility could not be a citizen of the United States, and must therefore give gecurity for coats. He also urged that the Count was & non-resident of the State ard submitted affidavits to that effect. Counsel also ssid what the plaintiff's complaint set forth bis pertoual bistory, travels aud adventures in Eu- rope, and showed letters from Monarchs felicitating the Count upon bis kind feelings toward these potentates ‘The Count eppeared in pereon in oppoaition to the mo- tion, and produced affivavits, passports, certificates and documents, to show that be was, in the moeaciag of the act, a resident within the jurisdiction of this court. Among o\her documents which be exhibited, was a paid board bill for three moaths The Court denied the motion to compel the plaintiff to give security, and gave $10 costs against the defendants, Fatat Mistaxe.—Coroner Jackman held an inquest me No, 189 East Seventh street upon the body of an infant child named Charles Christy, who died from the effects of & teaspoonful of Croton 0.1 administered to it in miatake for castor oil.
