Qo sux Hovonasua THs Common Counciy:— In compliance with section 29 of the charter of 1857, I faave the honor te submit the following report in retation to the businees of this department, to include the Sst of December tast. ‘Te Btrect Department has charge of street improve- ments, wharves and slips, roads and avenues, public Jands snd places, lamps and gas, construction and re- pairs of public Dduildings, supplics to public offices, expenditures for fire apparatus, removal of obstructions ‘and encombrances from streets aici harbers, and the eoilection of sseeeements. In the principal office, besides the Street Commissioner and Deputy, there are ten clerks, five iwspectors and three messengers. There are nine separate bureaus im the department, im each of which there is a superixtendent, er officer in charge, and the mecessary clerks and inspectors. This immense and varied Duriness, involving sn annuel expenditure ef about three millions of doilers—affecting, as it does, nearly every futereet iv the city, and being intimately connected with other departments, and largely dependent upon prompt action of the Common Councit—requires to be conducted with method an@ syetom, as well as strict.adherence to law. On the S0th April last, at the time Mr. Edward Cooper took charge of the Department, the basinces was tm a state of confusion and disorder borderimg on chave— The result, im part, of defective laws, of ignorance nd neglect, and of designing fraud; and in part ewing no dowdt to dhe fact that for six months @r more there had been no recognized Street Com- missioner, and consequently very very little business ove regular!y by the department during that time. The amount of office room was entirely inadequate, and seve- val of the Superiptendents had no offices and no records ef their business. Notwithstanding the fact that there ‘were ten separate bureaus in this department, hyndreds ef applications in reference to details of unimportant rou- time business, properly beleoging to the diferent bureaus, were brought iy direct to the Street Commissioner. Amongst otber things wore a large number of bills for work done or supplies farnished during the time that the office was contested, nearly all of which were irregular, nod some fraudulent—the whole amounting to more than pe bundred and fifty thousand dollars. Most of these Giaimaots, as well as other persons having business with She department, insisted upon seeing the Street’ Commis- sloner, and discussing day after day their own especial grievances. There were something like one hundred and Bity contracts for street improvements, involving large . imerests to property holders, contractors and the city— the Corporation acting as Justice with limited powers e coutracts, with Ecurce an exception, were found to be irregular, very many of them illegal, and gome fraudu- Jens. New ordinances for the government of the oppartment were prepared (See pro- @ee'ivg of the Board of Counei'men, Dec. 22, 1858.) and every effort was made to establish the whole business pen a proper basia, Much bed beea done towards the acoomplishment of this purpose before Mr. Cooper re- tired from the office; but this object has not yet been fully @tained, nor can it be until certain important changes @re made in the city charter and laws. The system adopted for the trapsaction of business, (ogaiu see circu. lar 1) the keeping of accounts and making payments, is thie:—The Superintendent of the Bureau baving charge of & particular kind of work or the furnishing of suppties maker to the Street Commissioner a written report, sct- ting forth the facts in the case anf his recommendation Wereupon. If approved the Sirecet Commissioner or Deputy certifics to the necessity of the expenditure, as re- quired by the charter, and orders the work to be doae, or the supplies to be furnished. The Superinvendent, after the execution of the work or the deitvery of the arvicles, examines the bill rendered to him, and if it ie found correct he bas triplicate vouchers made out in Yegular printed form (see appendix marked C, transmit- ted herewith,) on each of which Sho accouat is copied. The origival bill is fled in his office, and the triphcate vouchers, certified by bim, are transmitted to this office. If approved they are certified by the Street Commis. Neither the Street Commiesioaer nor o! officer of the department handles any of the pnblic money, ether than their own sataries—with the exception of the chief clerk, who has a mall account for postage, &., amnounting last year to $89 68 At the time Mr. Cooper came into possession of this office the contracts were made in a book ¢f printed forms, the bianss loft for prices being filed in with figures only, instead of being writen oat in werds. These figures, ip very many cases, ba? evideotly Dern altered; and in no case, for several years back, were any of the contracts signed by the Street Commissioner. I would respectfully call attention to the suggestions made ty the Superintendents of the Ba- reaus of Wharves, Roads, and Repairs and Supplies, in their rerorts to this department, alreaty transmitte{ to the Common Coonei!, rlative to the difficulty of making correct specifications and contracts for the numerons and frequently unforesen repairs which may be nesded on the old and dilapidated piers, roads and buildings under their respective charge. Monthly reports are required of all the Superintendents, stating the amount and kind of work done or supplies fa nished and the cost thereof, tne amount of the appropriations in each case, what has been expended, and the balance on hand, together with a return showing all the pubtic property in their possession. Again: It i irreguiar, to say the least, for the Common Council to accept work, audit accounts, and pass resolu- tions directing the Comptroiler to pay a specific amount for work done for the Corporation, aud charge the ame t a specific appropriaten which should be under the control of one .of the heads of department. Very large payments are made, too, out of specific appropriations upon judgments obtain- ed against the city, often for work doue or euppiies fur- vished years since. These and other paymeuts of a simi- lar chardeter would seem Properly to forma part of tae arrea: ages for the year, if there nO special provision made for their payment, rather than to charge them aga nét appropriations made for particular purposes, whica were intended to be exended under the control of one ot the executive departments. There is one other point to which I desire to refer in general terma, before speakin; of the business of the Superintendents of the Bureaas, an that isthe necessity of conferring more power on the Street Commissioner in regard to details of exocntive bu- siness. At present he is not entrusted with authority aut: ficient for the prompt aud eificient trangaction of the ita- mense public busiaess with which this department is charged, : THR BUREAU OF STREBT IMPROVEMENTS. Io this bureau (for full particalars.seo report to this De- nt of the Superintendent, transinitted to tne Com- mou Covneil on the 24th inst) the expenditaree are not only Dearly equal to those of ‘all the other bureans com- bined, but almost the whole amount ls paid from the Trust Fund moneys advanced by the city. To enable the Corpo- ration to colect nesesaments upan the property benefited by these improvements, authority is given ultimately to fell the property, and give title without the conseat of the Owner, This is well understood to be a right that should be exercised from urgent public necessity only; and must in every step of the process be carried out m exact ac- cordance with the prescribed letter of the law, the slight. eet irregulurity very properly vitiating the whole pro- ceedings.
