The accused is an Italian 400 aparently over forty years of age. ‘The first witness called was a young girl named Katha- rine Ceary, who being examined by Mr. Dwight, Assist- ant Urited States District Attorney, deposed that she at- tends te bakery store of Mr. Hewitt, in Crosby street; has known the defendant about two months; she came into the stor four times during these two months with $5 gold picces she bought nothing, but wanted change; she got them dianged twice; the third time she came she did not get thechange; the fourth time was last Saturday; she did not g@ the change then either; the lady of the store took them to the bank and they were returned to her; I could Hentify one of them; it was scr: on the side of thevagle; I did not mark it; it was 80 when she gave it to me. - (85 plece produced and identiled. Catherine Reiley deposed that she keeps a little store in | Crosby street; have known the prisoner about six months; she kept a room in Crosby strect; she lived with a man { there; whether he is her husband or not I do not know; 1 have seen two children with her; I do not know what business she does; last Saturday she was i my store between nine and ten o'clock; she called for @ quart of potatoes and two cents worth of wood; she gave me a $5 gold piece; I gave her the change in bills aud. ail- ver; the policeman came in in about a quarter of an hour and’ asked me if I had any gold; I showed it to him; I had no other gold in the house except whatI had taken from this woman from time to time; I had nine $5 pieces; I showed them all to Mr. Dilks; sometimes she would come m for a peck of coals, and for seven cents worth of things, coal and wood and little articles aud would give me a gold $5 piece each time; I bad $46 in those pieces saved up for the rent and for my children. Cross-examimed—My husband changed one of those gold pieces for the woman, and put it by where I had the oth- ers; he knew where I had them, and he had access to them; {told my husband of my changing those gold pieces, Abd he thought they were good. Hency Lambkohl—Keep a grocery store in Crosby street; have known the prisoner fur about two months; she was in the habit of buying three or four cents worth in my store,and would change a five dollar gold piece; she would change one or two & Week; Igave thetn all out again ex- cept one, Which I handed to oificer Dilks; I marked it, and would know itagain. She asked me for change on Jast Suturday, and I gave it her; she did not buy anything at the time; I put it in the drawer; there was no other gold coin there at the time; I gave it to Mr. Dilks in about two hours afterwards. Croes-examined—I was absent from the store about a quarter of an hour; my boy was there then; I did not mark it when I put it in the drawer, but did so when I gave it to the policeman. ‘Adjourned to Friday at one o'clock. Mrs. Reiley said she had not a cent of money in the house, and she did not know what to do. THE PEARL STREET HOMOCIDE CASE. ‘The inquest in the case of James F. Baker, the sailo who was fatally stabbed near the corner of Pearl and Elm streets, on Saturday night, by aman named John Lynch, was concluded yesterday, at the New York Hos pital, by Coroner O’Keefe. Henry Hughes testified that he resided at No. 536 Pear street; on hearing of the difficulty he proceeded up stairs and demanded admittance to deceased’s room; did not see any blood in the room, neither did he know of deceased’s being stabbed at that time; subsequently he learned from policemgn Muldoon that Baker had been stabbed. Patrick Muldoon, of the Sixth precinct police, deposed that on the night of the affray, he was on duty in Worth street, near Mission place, when a woman named Mary Lynch came and told him that deceased had been stabbed; the witness proceeded to No. 25 Mulberry street, and there found deceased; I saw that he was stabbed in two places; I asked him who inflicted the wounds, when he answered, ‘ Never mind, it is as much my fault as his;’ 1 then asked Maria Lynch to show me the man who stabbed deceased, when she accompa- nied me to the corner of Elm and Pearl streets; I pushed the door of the prisoner’s room open and asked for the knife; the knife was given to me by Mrs. Lynch; I saw no Divod’ on the knife; it appenred to have been cleaned; Ma- ria Lynch then pointed out the prisoner as the man who stabbed deceased, and I conveyed him tw the station hot use, Maria Lynch, sworn, deposed as follows:—I live in Pearl street, near Elm; deceased and myself boarded there with the prigoner; deceased came home on Saturday night about eight o'clock; he was under the influence of liquor; deceased insisted On going out to quarrel with a man; a dispute then arose between the prisoner and deceased; they bad a gouffle, after which deceased turned towards me and said he was stabbed; I was not aware that de- ceased was stabbed until he told me of it; [ recognise the knife shown me as belonging to the prisoner; deceased ‘was uot my husband, but lived with me as such. Ellen Lynch, wife of the prisoner, deposed as follows:— On the evening of Saturday, the 20th ultimo, I retired about 103, o'clock; deceased was in the house then, and wauted to go out and quarrel with some one; decased and Maria Lynch went out of the house together; but return- ed shortly afterwaras; a dispute arose between deceased and Maria, in which my husband joined; I saw a knife in the hands of Maria Lynch and attemy to take it from her, and in doing so cut my hand; I was ander the influ- ‘ence of liquor at the time; I saw no blood on the floor, or about the place; I saw no blood upon the knife. MariaLynch recallod—tI had not the knife in my pos- session during the affray. Mary Fitzgerald deposed, that on the night ef the difl- cufty she saw Maria Lynch and deceased leave the house and return shortly afterwards; about 12 o'clock that night heard a great noise in the room occupied by de- ceased, but knew not ihe cause thereof. George A. Quimby, M. D., deposed he attended de- ceased from the time he was admitted tb the New York Hispital nntil he died, aud gave the jury a lengthy de- scription of the injuries and the manner of treatment; made & post mortem examination of the body ten hours after death, and found general peretonitis and the pleural cavity filled with blood; in the opinion of the physician death was caused by peretonitis, combined with pleuro pneumonia and hmorrhage into the pleural cavity, tho result of the wounds already described. The case was here submitted to the jury, who, after due deliberation, rendered the following verdict:—' That the deceased, William F. Baker, came to Lis death by being stabbed with a knife, in the hands of John Lynch, aided and abetted by his wife Eilen.”? Upon the rendition of the above verdict, the prisoners were examined in the usual form prescribed by law, os follows -— John Lynch being duly examined before the under signed, according to law, on the annexed charge, and bug, informed that he was at liberty to ouswer or uob aii or any of the questions put to hin, states as followe:— Q What is yoor name? Klien Lynch, in answer to the usual questions, replied ‘that she was twenty-nine years old, was a native of Ire Jand, lived with her husband, and was by occupation a housekeeper. In answer to the charge preferred against her she said, “I have nothing to say.” The prisoners were both committed to the Tombs, in default of bail, to await the action of theGrand Jury. Dmapty Assacit Wren R Cart Rund.—Coroner Schirmer ‘was called upon yesterday to hold an ante-mortom cxami- mation at No. 71 Attorney strect, in the came of a man named Charles Smith, who, it is alleged, was dangerously beaten with a cart rung in the hands of two men named James Smith and Samuel Tyng, in a porter house in Clin- ten street, on Sunday morning. The accused parties were arrested at the time of the occurrence and were present during the examination of tho injured man. The friends and rela- tives of the deceased feel mucii aggrieved at the statements which bave appeared in print relative to the character of the latter, and claim that he was in no way connected with either thieves or rowdies, but, on the contrary, was an honest, hard working young man, Tax Curr Srkxer Traceny.—Julia Green, the woman who waé so brutally assauited by her husband at No. 150 Clift street, on Wednesday afternoon, still lingers at tho New York Hospital.
