Chaix d'Estange at the inauguration of the coorts, towhich I drew your attention in my last, has produced a violent discussion betwixt the Débats and the Conctitutionne!, on the relative merits of the English and French systems of ascertaining the gai or innocence of a prisoner. The truth is, the hatural vivacity of the French @haracter becomes £0 painfully evident under the system of interrogatory to which the prisoner is subjected in cri- minal prosecutions by the Judge, that the Débats, advo eating the English system, only gives expression to a growing public sentiment on the subject. The pri- eoner, despite the judicial ermine, endeavors, and sometimes with considerable acteness, to turn the lables en the examining judge, who, in his turn, cannot afford to bo Jeft in the lurch in the presence of the court, and re- partce, smart jokes, bon mots, &., are by no means rare im the courts of law throughout la belle France, or what is worse, an occasional violence of temper on the part of the Deng utterly destructive of all judicial dignity. Tt seems almost impossible that under such a system it should be otherwise; aud though the Constitutionnel has Droaght forward the late trials relating to the aientat of ‘the Mth of January, which occurred in France and Eng- land under their reapective systems, and triumphantly points to the tone of the lookers-on in the French court, as compared with the conduct exhibited by the same class ‘at the trial of Bernard, in England, the growing opinion I have alluded to will not the jegs continue to make pro- grees.
