from Honduras, @UR BELIZE CORRESPONDENCE. * ‘Buuzaz, Howpuras, Oot. 26, 1858. Indian Ravages and War, Followed by Commercial Fuil- ures—Affairs of Hyde, Hodge & 0o.—Trade Very Dull— Mahogany and Sugar Exports—Fine Weather—Publice Health Good—The Provision Market, de. ‘There seems to be no end to the strange events which ‘are to transpire in this town during the current year. Boring the first part of it we were in a state of alarm in vegard to the Indians up at the north. Then came the frightful rumors of the intended destraction of the towns ‘ef Gorogal, San Estaven and San Padro, by a band of dis- eontented desperadoes residing on the northern borders ef British Honduras. Next came the attempt, by @ por- téon of the same gang, to fire this town, and to murder ‘and rob some of our citizens, all of which you were ad- ‘vined of as they occurred. Then followed the conviction ‘ef two of the parties whobad conspired to burn this town, to morder and rob some of our citizens, and the severe gentence on the convicts, of imprisonment at hard labor for ten years, and to be publicly whipped through the town once in each six months during the term. Next came the astounding news of the failure of the house of Hyde, Hodge & Co., of London, which carried down the house of James Hyde & Co., of this town, and, eonsequent on them the houses of J. Carmichael, of Liver- pool; A. Montgomery & Co., and others, of London; Carmi- ehea), Vidul & Co. , and it is feared others will have tofollow, ae nearly al! are large creditors to Hyde, Hodge & Co., who are supposed to owe near two millions of pounds sterling. "The firm of James Hyde & Co. has been for some years past receiving on interest the moneys of parties here who had money to put at interest. In nearly every case these sums of money so deposited comprise the all of the de- pesitors, who, if they are not paid, will be ruined. They ‘are in many instances widows, children, maids and old people, who are now reduced to beggary, or will be if the attempt now being made by some of the large credi- ters of England to merge the claims of James Hyde & @o., of Belize, with those of Hyde, Hodge & Co., of Lon- don, does not succeed. There bas been a meeting ef the creditors of James Hyde & Co. in Belize; bet as they had no organization or head, and no concert or system of action, Mr. Hodge ma- ed to get a resolution passed at that meeting © refer the matter to Chief Justice Temple, of our Supreme Court. This course was firmly opposed by’the business men here: Dut they were overruled by the inexperienced, who all think Chief Justice Temple will decide in their favor on the score of their poverty and want, This is a very important question to this settlement— ‘and it is a question of some consequence to the commercial werld—as the firm of James Hyde & Co, are abundantly solvent, they having more than two and a half dollars in property here for every dollar they owe, while the firm iyde, Hodge & Co., of London, owe thirty dollars for Sar dollar of assets.’ The house here has been conduct- ed fairly, honestly and prosperously, while that in London has been astock (coolic) and African speculation, sustained by the cash deposits of the people in this town. In consequence of failures business is very dull. Money is very scarce, and there ig no such thing as confidence; each seeks ‘after what ig due bim and will take no denial. Credit is suspended, and worse and more of it seems to be ahead. ‘Our mahogany cutters have done well this year—that is, they have got out large quantiles of good wood, but prices ‘are very low here and in England, besites which ‘there are Jarge quantities. of last year’s cutting still on hand unsold. This will soon be forced into market, and sold, most likely, at a great sacritee, which will seriously affect our solvent houses here in the wood cutting business. Large quantities of sugar and rum have been raised this year at the northward, some of which has been exported to New Orleans and to New York; but how it is done is a mystery to me, as it is worth 35 here, cash, which wi with freight, commissions and duty in the United States, will exceed $8 per 100 Ibs. And how it can be done, and made to pay, is the mystery. We are now enjoying very delightfar weather. Our town is quite bealthy, and our mahogany cutters are com in for the Christmas. ere is nothiog new from the Indiansin Yucatan. Oor soldiers who were up to the borders of our territory Lave returned to Belize. From Guatamala, Honduras and San Salvador there is nothing new since my last. Our provision market is well supplied with everything. @ur market for cochineal, indigo, sarsaparilla and ores 6 very active. Beuze, Hoxpuras, Oct. 27, 1858. Judicial Decision in the Case of Hyde & Co.—1wo New York Vessels Leaving Port—Admiration of them by the Residents of the Town—Preparing for a Race, ée. Since my last a decision has been given in the Supreme Gourt by the Chief Justice and the two newly made judges, in relation to a sum of money which had been deposited im the hands of James Hyde & Co., in trust for the deposi- tor, subject to his call, but which sum Mr. Hodge refused to refund, on the ground that it had been entered on the books of his firm by his cashier in the regular way, and by this had become a part of the effects of James Hyde & Co.; but the Court decided this sum was not the property ‘of James Hyde & Co.,and that that firm must nust pay the the amount over to the’ depositor forthwith. gave Very general! satisfaction, and the parties bi he hold laims against them for money deposited are sanguine they will all get paid in full. ‘This is ust, and if done will be of immense benefit to this town, as it will restore to a great ber of people their only means of subsist: ence. wi of the'otner, ered! creditors have submitted their Claims to the Chief Justice, who will give bis opinion on Thursday wext, the 28th inst., whether by the laws of this ranma the creditors of Belizo aro not entitled 10 be in full imimediatel, ine bark D. dex, ate, master, and the bark Honduras, Bates, master, both of your city, and both fine new ves: nels ‘and crack sailers, are bow weighing anchor for your port. Nov.15.—Phomas O'Riley vs. John McG@uire and Wil- liam Robinson.—In September last Riley made a bet of $102 with McGuire that one John Lynch was not a mem- ber of the Democratic County Convention of 1867. The mon-y »as deposited in the hands of the defendant, Robin- son. “This aetion is brought to recover back the amount of the weger. TaowrmN,J.—It is provided by statute that “ All wagers, be'8 or stakes, made to depend upon any race, oF upon any yeming by lot or chance, or upon any lot, chance. casual y, or unknown or conti ngent event whatever, be uniawfu!, All contracts for or on account of any money or prcperty, or ie in action so wagered, bet or Blaked, Sluis void.”? R. 8., 72.) It is very bertain that the plait tiff cannot are under the statute, for the bet in questicn depended upon neither of the contingencies therein enumerated. Is is void then at common law? Wagers are not void unless they affect the interests, feel- ings or character of third persons, or lead to indecent evi- dence, or are contrary to public policy, or tend to immo- rally or to a breach of some law. (2 Pars. on Con., 261.) wr as this wager is hopes it can in no possibie le of public policy which I can imagine. It is a matter in which society can take no kind of interest nor suffer any conceivable injury. It can only affect the person who has foolishly and improvidently lost his money.. If it were the duty of the courts to find re- medies for all the silly acts of inconsiderate men, it would involve the neceesity for a number of tribunals which the community would scarcely feel disposed to create. Neither by statute nor at common law can the plaintiff maintain this action. Judgment, therefore, for the de- fendants, with costs. Before Hon. Judge McCarthy. ACTION FOR PALS ARREST OF A LADY. Nov. 17.—Edwin Robinson and Mary his wife vs. Wil- lam A. Moore.—This action is brought to recover 9600, for assault, false arrest and malicious prosecution, It was alleged by Mesers. Hurley & O'Rourke, for the plaintifis, that on the 16th of October last Mrs. Robinson went to the defendant’s store to purchase a pair of gloves, but not being suited, she asked one of the lady attendants to allow her to adjust her dress. She was subsequently charged with stealing a pair of gloves, was arrested and tried at the Sessions, where she was acquitted. The defence was a general denial and that there was probable cause for the suspicion. The plaintiffs’ counsel offered to pat Mrs. Robinson on the stand to explain the transaction, but the Court decided that a woman could not be @ wit ness for her husband, and refused to allow her to be ex- amined. The counsel having summea up, the Judge charged the jury that in an action of this kind the de- fendant must prove that chere was probable cause for the arrest of the plaintiff's wife, and that the fhet of her having been acquitted of the charge was uot sifficient to entitle her to damages; but it was incumbent on the lady to prove that her arrest was made from malicious motives or without any probable cause. The Court also observed that if the defendant believed in his own mind that a theft was committed, (although it should turn oat that he was mistaken,) he would not be liable. If the jury believed that the plaintiff was entitled to recover, then they should give her all her expenses and a compen” Sation fcr the injuries to her character. Judge Matlin, Nov. 17.— Valentine Luse and Wife vs. — Meyers.—This Was av action to recover $5,000 for injuries sustained by Mrs. Luze, while ona voyage to this country, on board the ship Yorktown, from London. It was alleged that in August, 1856, the plaintiff and his wife took passage on board the Yorktown, and during the voyage a plank fell down and struck Mrs. Luze, fracturing her leg and arm, For the defence it was set up that the master of the ship ‘was not liable for personal injuries sustained by passen- gors.
