The writers do not re- present an abundance of provisions in the Territory; om the contrary, it is represented that there is much misery from wa Many of the Mormons who left San Bernardino in the fall for Great Salt Lake City are said to be much dissatisfied and longing to re turn. They have not gone to the capital of the Ter- ritory, their original destination, but have settled down about two ‘hundred miles soath of it, at Beaver Creek, somewhere aboat fifty miles north of their settlement at Parowan. The scarcity of provisions 8 assigned as the reason for stopping the emigration at that distance from the seat o: empire. Captain flant, formerly of the Legislature, and probably the richest. man of the San Bernandino settlement, who sold his mill avd property in the fall for $2,500, while its actual value was $25,000, is reported to be among the dissatistied and likely to return to his former stamping ground a broken man. These re- ports, true or false, are widely circulated and gene- rally believed. Some think they discover behind the reports an effort to create sympathy for the Mor- mons, and possibly a ruse for some to return and get another baul from the Gentiles. San Bernsrdino is now suid to be flourishing rapid- ly in commerce, under the oes of the vew citi- rena, and to all appearance it is becoming an uncom- ortable place of sojourn for the remnant of the Mor- nons that still linger behind. JURISDICTION—FREIGHT—CARTAGE OF COAL. John Gaughran vs. 151 ‘tons of Coal.—This waa 2 libel to recover freight upon the coal brought by the jibellant from Schuylkill Haven to tcis port for $185 per ton. William Minziesvs. The Bark Agnes.~This wasa libel to recover for certain timber furpisned for the vessel to Frekine for building the same vessel. No direct evidence was piven whether the timber was furvished to Erskine or Girectly to the vessel. But enough evidence wae given to raise & presumption chat the livellant and Erskine dealt in respect tothe lumber on the understanding that it was spp ied mainly, ifnot who'ly, for the particalar vessel. Held by the Court—That this affords adequate ground for lieu in favor of the vender to the value of the material used in the veesel. But it devolves upon the libeliant to establish by clear evidence the quantity and value of the materia! procured for aod nsed in constructing this vessel.
