8 ‘The Lottery Policy Question. DECISION OF THE RECORDER OVERRULING TIE MOTION TO QUASH INDICTMENTS AGAINST ALLBGED POLICY | VENDERS. | In the General Seenions yesterday morning Recorder Barnard de)ivered the following able and elaborate opinion — ‘9p motion of counsel for Jacob Boagers, overruling the mo- don to quaeh the indictments and ordering the defendant — to start his trial, This decision will effect a large num:er ‘of similar indictments. ‘The indictment in this case was found under the law passed in 1851, and amended in 1855, entitled “An act | more effectually to supprese gambling.” The motion quash the indictment was made before me on the last day of the February term of this court. M. ‘The tone of the stock market was altogether dif- ferent to-day. The tendency of prices w 8 upward, and in some of the leading speculative stocks there was a very active basineas, at the first board Erie Railroad 3d mortgage bonds advanced 1 per ceut; La Crosse land grand bonds 1; New York Central Railroad, 1; Erie, 4; Hudson River Railroad, 1; Har- Jem, 4; Reading, 13; Michigan Central Ruilroad, 14; Michigan Southern, common, {; do. preferred,}; Ga Jena aud Chicago, 1§; Cleveland and Pittsburg, 4; Chiengo and Rock Island, 3. Hudson River Rail- road Int mortgage bonds declined 1 per cent; Paua- ma, 4; Ilinois Central Railroad, 14. There were a gocd many cash buyers in the market, and prices left off better than at the opening. New York Cen- tra! Railroad and Erie Raitroad are undoubtedly fa- rubly affected in market value by toreign orders. It appears that New York Central Railroad shares were, at the latest dates quoted in London, at 82 a 84 per cent,and Erie Railroad shares at 26 a 28 per cent. This is equal to about 90 a 92 percent for New York Central shares, and about 28 a 30 for Erie Railroad shares. The latest advices received in London trom this market were to the loth February, and at that time quotations ruling for both of these stocks were considerably ander those now current. At that time Erie was selling at 28$ a 29 per cent cash, and New York Central at 86 a 86} per cent cash, Fvery -teamer from this side, from the mid- die of February up to Saturday last, a period of three weeks, has taken out accounts of a rising mar- ket. We have yet to receive the response from Eng- land and from the Ooutinent, and the probability is that the rapid restoration of values ia our most pro- minent securities will create a speculative movement in London and an active demand for American stocks generally. We have no doubt that the next steamer from Europe will bring quotations for our securities considerably above this market, and or- ders tor large amounts s0 liberally limited as to permit their immediate fulfilment. The recent dectine in our own market has enabled parties holding foreign orders limited to figures corresponding with the last quotations in London to fill them. This absorption must have a favorable effect upun prices here. Such operations permanently relieve holders on this side, as itis the withdrawal of so much stock from the market. ‘The eflect of this demand is likely to be seen sooner in New York Central, Erie, Michigan Central and Illinois Central, from t hat foreign capitalists bave already large | (sin them, aud prefer them to any others. tucks must continue to absorb large amounts | foreign capital. They all pay comparatively high rates of interest, and as for real bona fide security there is nothing better in the world. Any political distarbance in Europe must force an immense amount of foreign capital into our public securities; and, in any event, with peace or ; war, the investment in our stocks from abroad is likely to largely increase. Most of the discoveries have been made by the ccidental detection of one of the parties—as in the case of the American Exchange, the National, the Mechanics’ Banking Association, &c., &c.—a new one appearing at regular quarterly iutervals, In the case of the Union Bank, it is now announced that the main default cecurred pearly ten years ago, and was regularly, of course, counted in as assets and sur- plus undivided protits. The amonnt of the defalca- tion is unkuown, and as every effort has been made t keep it from the public eye, it 6 doubtfol if it ever will be known, as it would take weeks of examination and compa- rison by experts to approach ita amount, It is sur- mised that it may floally involve others, either out- side or inside, and that it will be found eventually to be abort balf a million. A few days ago we fur- nished the statement of the committee of the examiners of the Bank of Pennsylvania, showing that while it was not solvent or had earned a divi- dend since 1853, bad regularly declared semi-annual ones, amounting in that period to forty-seven per cent of ite capital. And the directors always be- lieved they were earned, and that the bank had a handsome surplus for contingencies, being hood- winked by adrvit managers and accountants. It re- quires no ordinary judgment to perceive that, as an investment, bank stocks are the most dan gerously tncertain property any one can put his money in. We know that these views are entertained by the leading financiers of this city, and to it is to be attributed ina great measure the rapid rise in the better class of divi- dend paying railroad shares and first class bonds. Among the various means to bring about a return of a healthy condition of the various interests of the public which fall within the legitimate scope of legislative action, there are noae which would 50 cer- tainly and immediately prove beneficial to all classes ax the enactment of the law now before the State Senate admitting aliens to hold and convey real extute in the same way as citizens do. The law as it stands is a relic of barbarity and weakness. Nothing is to be feared from the influence of foreign capital invested in houses and lands; still less, if possible, than when it is invested in public stocks. The in- vestment of a large amount of alien capital in houses, lots or farms, is the shape of all others most ac- ceptable to us, because it is less liable to be suddenly withdrawn, and because it gives employmeut to every branch of industry.
