Houston. Their introduction cre- ated no little amusement. Senators were under the im- pression that they were intended as a hit at the immortal fifteen who composed the Retiring Board. Such, how- ever, is mot the case. The General informs me that he imtends to press their consideration in the Senate at an early day ; and that he is determined to show up the men ‘who constituted that star chamber proceeding. The plaintiff in his affidavit, upon which the order to hold to bail was founded, sets forth the following facts:—That he, the plaintiff, on the 5th day of December, A. D. 1855, was the owner of the stqgm- ships Ocean Bird and St. Lawrence, and of one undivided third part of the United States or Mexico, all of the value dollars. The transaction is said to have taken place in the city of New York; and as, I petted the State of New York, all conveyances, for the security of an usurious loan of money are declared to be absolutely such laws, the party making a convey- property, for the security of an usurious loan of money bas a right to proceed in an action of tro- ver against the party loaning and receiving the pro- io. as Ae Xe he converts it to bis own it follows—as the defendant is charged in the "affidavit with making the usurious loan, with receiv- ing the steamships as a secarity for such usurious loam, ana with refusing to er them up to the plaintiff, upon a demand being made for the same—that there is a good cause of action chown in the afficavit; and if the allega tions in the affidavit are true, the plaintiff has a right to require that the defendant be holden to bail. An order was thereupon passed to hold bim to bail. And as disin- terested witnesses ewore that the steamships were worth the eum of three hundred and sixty thousand dollars, the defendant was ordered to be holden to bail in that amount, ‘A motion is now made by the defendant to be discharged ‘on common bai!, or to mitigate the amount for which he is now holden. The facts upon which this motion is founded admit of little or ne doubt, On the fifth day of December, A. Stucken insists that there was no joan; that the transaction was an abso- Yate sale of the ships for a valuable and adequate consi deration paid. In considering the motion now made,I will assume that the transaction between the plaintiff and Stucken was an usurious loan of money, that the transfer of the steamship was in reality merely a security for such joan of money, and that Stacken would be liable to the aoe in an action of trover for the value of the 5 1 do this merely for the purposes of this case, without intending to intimate what, in my opin- V~) was the true nature of the transaction between laintitY and Stucken, as there is no neces peo for me to determine what ite true nature was to make a true disposition of the motion now under coa sideration. The defendant was not consulted in reference to the transaction between the plaintiff and Stucken, and the comtract between them was negotiated and concluded when he was absent in Europe, and he had nothing of any usurious transaction between the plaintifl | and Stucken, if any took place. There is no evidence that, to the commencement of the plaintiff's suit, he was — ever informed that the plaintiff claimed that the transac- tion between him and Stacken was an usurious one.
