The Bina Insurance Company o& Hartford, Connectiout.—This cause was partly tried once Before, but on an objection raised by defendants’ counsel, ‘that the plaintiff was barred in the action, as the sult was met commenced until alt lapse of twelve months, the Court so held and dismissed the complaint. The case comes up again on exceptions to the ruling of that Court, 34 is an action to compel the defendants to pay the amount ofa lost by fire bappening to the property ‘of the Glendale Woollen Company, on the 8th of April, 1849, the claim having been assigned to the plaintiff. The reason given by the defendants tor refusing payment was, that in asur vey referred to in the policy two of the questions put to insured Were incorrectly answered, Vi ticn—Is there a watchman in ie alll during the a there also a good Watch clock?
