FROPOSITION TO INDEMNIFY THE MAYOR YOR EXPENSES 1 TESTING THR CONSTITTIONALITY OF THE METROPOLITAN PO- PCE BILL AND TUK RIGHT TO AYPOINT A STREET COMMIS SIONER. Alderman McSrrpow offered the following resolution: — That the costs of the various actions and proceedings (hat have been taken by and against the Mayor of this city, mupce the 1 15th of April last, in the several courts of this pi in testing the constitutionality of the Metro- politan rel ice bill, and the right of the Mayor and Common ‘Council to appoint a Street Commissioner, and the costs of all actions and proceedings that have been brought against Fernando Wood, in his own name, for acts performed by Dim as Mayor, be, and they are hereby, made.a city charge, and the Comptroller is authorized and directed to pay the id bills and costs on presentation. Adopted. TER REORGANIZATION OF THE FINANCE DEPARTMENT. The ordinance reorganizing the Finance Department, in socordance with the charter. was called up. It has been previously published, and several times before the Board. Alderman MeSrenox moved that each section be taken After some opposition, Alderman Friwer moved that the whole ordinance be adopted. It had been read, he said, forty times, and there was no use in going through it again. Alderman TccxeR hoped not. He had examined the Ordinance, and he contended that it ought not to be adopt- dasa whole. The ordinance was adopted as a whole. MEETINGS OF THE BOARD. On motion of Alderman FuLMen, the Board resolved to meet on Tuesday at four o'clock, ‘on Wednesday at five o'clock, and on Thursday at four, this week. INCREASE OF SALARY YOR THE JUDGES OF THE MARINE COURT, A petition was received from the Justices of the Marine Court for increase of salary, in consequence of the laws recently passed by the Legislature having imposed upon Also, to | them additional duties. Alderman Covrrer offered a resolution{to the effect that the Justices of the Marine Court be allowed $4,000 each per annum, instead of $3,000, to commence from Ist Ja- nuary , 1858. This was opposed by Aldermen Blunt and Tucker. Alderman Drake advocated the increase in consequence of the additional duties imposed upon the Judges of the Marine Court, and the resolution was adopted by a vote of EXPENSES POR THE TRIAL OF CANCEMI. A Dill was received from Messrs Blankman and Ash- meade for $172, for expenses of witnesses, &c., on the last trial of Cancemi, convicted of the murder of policeman Anderson. NEWSPAPER RILIS. By the bills presented for advertising the city canvass it appeared that that the charge for advertising in the New York Hrrarp, with its 70,000 to 80,000 circulation, ‘was only $272 $7, whilst those of the Sunday papers were $269 12 cach. The whole amount was $2,206 68. Re ferred. EXPENSES FOR FITTING UP THE SUPREME COURTS. The bills for refitting the Supreme Court rooms, which had been referred back to the committee, were again re- ported upon by Alderman Moneghan. The bills are the same as those formerly before the Board, with the ex. ception that the committee deducted 10 per cent from the bill of Mr. Fowler, Alderman Bicnt made a minority report, showing over- charges in twenty-eight items, which he said nearly doubled what they should be. Enamelled muslin was charged as leather. Alderman B. went through the bill, contending thatthe prices were over charges, and that the work done was inferior. ‘The majority report in favor of paying the bills was lost, there being a Lie vote of 10 to 10, The Board then adjourned to Wednesday at 4 o'clock "The Alleged Caba Fillbusters in Court THE CASE ABRURTLY TERMINATED—MR. OAKSMITI SWEARS THAT AT THE TIME OF EFFECTING THE INSURANCE ON THE VICTORY HE HAD BUT A FEW THOUSAND DOLLARS PERSONAL INTEREST—THE COURT RULES THAT HE CAN RECOVER ONLY THAT AMOUNT, AND THE PLAINTIFF OBTAINS TWENTY DAYS TO MAKE A NEW CASE. SUPREME COCRT—PART SECOND. Refore Hon. Judge Duer and a Jury. Dee. 21.—The court opened ata quarter past eleven o'clock. Sidney Oakemith was on the stand at the closing of the court on Saturday, and resumed the stand. By Mr. Dean—I recollect spending Christmas in Port- land; I left Boston on the 7th of December; at Port au Prince I had part of the goods of the Amelia taken out and put on deck; that was before her seizure; 1 know John Crawford, who has been examined as a witness; (Craw- ford’s affidavit of 1856 exhibited to witness;) Crawford ‘Was pot in the country when this is dated; Iwas present when the statement was made; my brother was not in the city at the time the affidavit was taken; thé affidavit was made from Crawford's statements; he came to my place of business alone: T did not know the tendency of them until T knew who he was. By the Court—He was alone; 1 took him up to Mr. Donobue’s office and he made the affidavit. By Mr. Dean—I did not know him before; he came in and avked for Mr. Caksmith. By Mr. Lord—I think Crawford called upon me in the middle of the day; there was nothing said about his motive for making the statement: I have seen him since; Tean't say how often; 1 don’t think it w: ¢; Lthink he then asked for my brother, who was not in; be said he had just arrived, 1 think from Phila delpbia; I did not ask ‘him about an affidavit which bad been made in Rabway; I aid not know of that By Mr. Dean—I recollect the transfer of the forge from some jokes which passed among the ¢ one suggested that be should be set up as a travelling biacksmith. Mr. Lord waived the reading of the entries, and Mr. Tean proceeded to read them, showing her to be of 297 tong, single deck, copper fastened, common mode! A te) fair built and fitted {coppered in 1847; on dock December, 1848; good looking vessel; bilge kelsons; caulked and zinced March, 1862; recanlked and bottom ginced Novem- pod = she rated A 2 when built, but rated lower af- wards, Appleton Oakemith recalled—By Mr. Dean—The Amelia ‘Was a provincial built vessel, sharper on the bottom than the Victory: she would draw more water than the other vessels; ste had originally a cabin; she was once fitted for California, and Poop was extend- ed to the main hatch; she had but one hatch on deck, there was no aft hatch on deck; T never told Mr, Goicouria that I would replace all the ar- ticles on thy V ; the Amelia never came back to New York after she left in Fe! » 1855, Mr. Lord here admitted that the second voyage was not an illegal —— Mr. Oaksmith—The Amelia was loaded partly in Wil- liamsburg ata bulkhead near Stack’s yard, and partly in another place, By the Court—The cargo was a portion of the same lot ef goods purchased by Goicouria and others; 1 did not give Goicouria an invoice of the cargo when the Amelia sailed; there was no evidence of what the cargo was; Hitchcock & Co. had no evidence ot what the cargo was except the statement of Mr. Goicouria as to what the Amelia contained; he came to my office and got my keeker to make outa statement for him; 1 den’t know sitet ‘has become of that statement; I only knew general- iy that the cargo consisted of ammunition &c.; when the Victory came back the second tine made an insurance on her and had an into‘est in her of about $30,000; 1 acquired the interes for expenses which I had sibsequently paid; at the time of the insurance—I bad only an interest trust—no per- sonal interest. ‘The Court—Why, gentlemen, that isan end of the case. A Juror—That is what I always unserstood. The Court—If I had known that I vould have relieved you gentlemen of the case a week ago. The Court—Unlees he had been aa owner the insurance was for the benefitof Goicuria, aad he was entitled to the benefit of the policy. Mr. Dean—We have an as:ignment of this policy from Mr. Goicuria dated February, 1855, to Mr. Oaksmith. ‘The Court—The complaint states tha he (Oaxsmith) was the sole owner, while the proof is that he was but a trustee. Mr. Lord—This is but an fssignment of the right to sue under the policy. The Court—It reste with Mr. Lord whether this question of law shall be reserved, and you stall haye a decision as to the facts. Mr. Lord said he bad ratber ensult with his associ- ates. He briefly argued to the Court that so far as the guns. I do not recollect the date: I should say the money ‘Was paid before the date of the bill. By the Court—Some person Fequented me to make out these bills in the name of Mr. Oakemith, Ry Mr. lerd—I should judge that Goicouria sent me about $21,000 of the $34,000; 1 had not the pleasure of Mr. Onkemith’s acquaintance at the time; 1 would not have made these duplicate bills at Mr. Oaksmith’s request without the assent of the person who sent me. Mr. Dean read the bills for 500 Sharpe's rifies, and for 1,000 Sharpe's carbines, at $90 each, cartridges, &c., at, 84 000. 1 Welcome R. If the counsel inaist upon that objection I shal! certainly hold that the action canaot be maintained. Mr. Dean—I shal! insist tha this assignment should be received in evidence. Mr. Lord objected, though he thought it would not vary the case. The Court—The comp!aint is that Mr. Oaksmith was the owner of the property at the time of making the insur- ance,and atthe time of the lose; if he had no interest at the time of the insuraxce or at the time of the loss, he cannot recover, Mr. Dean, to the witnese—At the time that this policy was issued’ had you afvanced any money upon these things?
