Commissioner Joun Hoover objected to that part of the minutes which referred to the establishment of heads of departments in the hree Academy. SCHOOL FUNDE FOR 1853, ‘The following communication wae received from the Fi- mance Commissioners appointed under the new charter:— The undersigned, to whom the estimates of the Board of Education has been submitted for the expendi- ures of the year 1868, according to the re- quirements of the 26th’ section of the charter, of 1857, having examined the said estimate, and having ascertained the number of scholars taught during the pre- coding year, and the apportioument of school money made by the State Superintendent of Public Instruction, ‘nd the facts to be as follows, viz:— ‘The number o scholars taught in the public schools of the city for the year precedfng, as prescribed by the School act, is 135,722. This number cf scholars, at four dollars per scholar, authorizes a levy for seheo! purposes, as provided by the 46th section of the School act of 1851 the sum of $542,888. ‘The 15th section of the same act provides that the Board ef Supervisors «ball annually raise, by tax, a sum of money equal ‘tothe amonnt apportioned to the’ county of New York, for the support of common echools therein, This amount is as follows:— From the United States Deposit and Common School funds.......... ‘Prom the three-quarter mili tax fan ‘Total..... ‘The same section also provides that there shall be raised sum equal to one twentieth of one per centef the value ‘of the real and personal property in the said city. City Intelligence, ‘Bre yor Tue Propose New ARaENAL.—At the last ses- sion of the State Legislature a law was passed appointing ‘8 Commission to sell all the old arsenals in the State, and build new ones where they were required. By theterms of the law, Adjutant-General Frederick Townsend, Inspec- tor-General B, H. Bruce and Commissary-General J. H. H. Ward, were appointed such Commission. Under their ‘auspices the old arsenal, corner of Fifth avenue and Sixty- first street, was sold to the city, and they have recently invited proposals for the erection of a new arsenal at the — ap ager omme and Thirty-fifth ry pap noon the bids were formally oftice the Commission, at the corner of White ‘and Elm streets. The Commission is limited in its expenditure to $100,000 for the whole establishment. It is to be hoped ‘that the new arsenal will be better built than the old one. That was one of the most Neem | constructed edifices in the city, although it cast a great deal of money. A Graxp Tiemann Stag Party—Pourics AMONG THE Urrgr Tey.—It will be remembered that Mr. Tiemann owed his nomination for the office of Mayor to a committee of Wall street bulls and bears, and his election is mainly due to the overwhelming vote he received in the wards where the upper ten domost congregate. Consequently the people who live in brown stone fronts are quite rejoiced at the result of the charter election, and are about to manifest their joy in a characteristic manner. If the de- meocracy had been successful there would doubtless nave been a inass meeting at Tammany Hall to exchange felici- tations on the result; but fashionable people could not do thing so commonplace, go it is in contemplation to hold a grand party, to which the éite of the wealthy Tiemann- ites bave been invited, and which will no doubt be a very curious affair. It seems cards are out for ‘a grand Tiemann party, to be held at the house of Benjamin H. Fields, in Madison avenue, on the evening of the 23d of December. Some 500 invitations have been issued, exclusively to gent! ae hence itis therefore what is known as a “stag Mr. Tiemann is to be present. What the ulterior partoee of this curious meeting is, it is impossible to say, at it is reported that a movement is to be inaugurated, which, if successful, will eventuate in placing the govern: ment of the city in the hands of the wealthy classes. It is urged that ail the places of pants trust are given to poor uneducated fellows, and the Fifth avenue people are of very little account in political circles. This dreadful state of things is to be amended forthwith, and no one will be allowed to run for office except he wears nicely polished boots and eports a fancy moustache. To make this party as fashionable as possible the magnificent eran been engaged, and will do the honors on the ‘occasion. Pouck CurRKs.—The Police Commissioners, in secret session, on Tuesday, made the following appointments of police clerks :— At the Jombs—R. H. Johnston and E. M. Skidmore, the prevent incumbents, and C. M. Vandervoort (reporter). At Jefferson Market Court—James M. Murray, present incumbent, and Merwin N. Jones, now assistant clerk, vice Jobn Quackenbush, elected Justice. At Essex Market—John Lalor and Wm. B. Rockwell. At Yorkville—George W. Ribblett, late County Clerk, vice James M. Burns. The Board of Aldermen formerly had the appointment of these clerks, and, it is understood, will contest the aoe law, and make appolutments for the same offices. Police Commissioners have also appointed Dre. E. ii. Kim- bark and Alanson S. Jones as police surgeons, to take office immediately. An additional number of surgeons will be chosen on Friday. Faut at St, Bripaer's Cuvxen.—A fair was opened at St, Bridget’s church on Monday last, and will continue during the remainder of the week. The proceeds are to be de voted to the completion of the free schoo! connected with the church, and which is said to be one of the best build- ings of the kind in the city. Since the opening of the fair | ithas been very successful, and it is expected that the | amount realized wili be amply sufficient for the purpose. ‘There are a large number of useful and ornamental arti cles on exhibition, and the tables are arranged with much taste. The Archbishop is to be present this evening. Fivm Lowr Acapryt—A Woxas Brxvep.—The alarm of fire for the Fourth district, last night, between 5 and 6 o'clock, was caused by a fluid lamp catching tire while in the hands of Mrs. Alice Stoole, No. 3 Multigan place, in Sixth avenue, between Amos and Weet Fleventh streets. Mrs. 8. was very severely burned on both arms and ber right side. Her clothing caught fire, when she rushed down stairs to the street door, enveloped in ablaze. Her husband, who was just entering the house, extinguished the flames, and thus probably saved the 1if fe of his wife They have only been married one week. Fu ix Bicury-rirm Strxet.—About 12 o'clock on Tuesday noon a fire broke out in the bakery of Mr. Strauz, in Bighty fifth street, near Third avenue. The flames ex- tended to the blacksmith shop of Robert Kirkpatrick, and before the fire was extinguished his shop waa damaged about $200; partly covered by insurance. The damage done to the bakery will probably amount to $300, In- sured for $1,300 ih the Rutgers Insurance Company. The fire is supposed to have been caused by the oven hoes. Campen® Lamp Exriosion.—The alarm of fire for the ‘Third district, last night, about half past 7 o'clock, was caused by the upsetting of a ca:mphene lamp on the fourth floor of No. 52 Dominick street, in the premises occupied by Thomas 8. Guillan. The flames were soon extm guished. trifling. Police Intelligence. GREAT ROBPERY OF JEWELRY—ARREST OF THE AL- LEDGED THIEVES AND RECOVERY OF THE STOLEN PROPERTY. On Wednesday night an expert robbery of jewelry was effected, by two men and a woman, at the store of Mar. quess Jacobs, No. 82 Oliver strect. Kate Connery, John ‘Stuart and Thomas Williams entered the above store for the ostensible purpose of buying jewelry. While Mrs. Jacobs was showing Kate some finger rings, Messrs. Stu. art and Williams seized @ box of watches, valued at $600, and ran off with the same. Kate followed quickly in the footsteps of her accomplices, and the three get off at no ordinary rate of speed. The wife of the worthy jeweller | pureved the thieves for several blocks, but owing to the extreme darkness of the ni and the poor quality of gas furaiabed 7 the New York Gas Light Company, she lost track of them, and was compelled to return to the store =m decomfitted. From the evidence adduced it ap- peared that about a month ago some one stole twelve sets of bi¥iard balle from the factor; a Frederick G. Ford, No. 102 Fulton street. The thief sold the property to Rosenbaum. From Rosenbaum’s hands it into those of Feileman,; from Felleman's back to Rosenbaum, thence to Goslick’s; from Goslick’s to Jacob Levine's, and from Jacob Levine's to his brother Iaaac, The last named f= offered the balle for eale at the billiard factory of ‘illiamn J. Sharp, No. 148 Fukten street, but hore linac made a mis-cue. Sharp suspected that there was some- thing wrong, and caused the arrest of the entire aparty. There does not appear to be any evidence against the cored showing a guilty knowledge on their part in baying the property. They were held for a hearing nevertheless. Cuakor of Honway Rowsmry.—William Brady, Andrew Tang and Lewis Martin wore takem into custody on charge Of having forcibly robbed Honore Ruyotte, of No. 17 Hud- fon street, of a sliver watch and a pocketbook, containing $7 60. The complainant alleges that while be was in the grocery store corner of Leonard and Church streets the | yy called for drinks, and then requested nim to pay the same. Complainant refused to accede to the pro- position, when Brady, he charges, seized him by the throat, knocked him down, and, assisted by the other pri- sonere, robbed him of his watch and pare, ae aforesaid. Judge Roose'ceit, Cancemi, the prisoner, was convict 4¢ of marder, not at a Court of Oyer and Terminer, bu% at a Circ He was sentenced, not by the Circuit, bu!, by a general term of the Supreme Court. His counsel eege various supposed er rors in the proceedings, trial and sentence—come of (hem. of a grave and novel character, and on which the Judges at the general term were divided in opinion. He now asks that the executica of his sentence may be stayed for a few days, and, that he may be allowed to carry his case tothe Court of Appeals. This can only be done, it is supposed, on the fiat of a Judge of the Supreme Court, and which the Judge may grant or withhold accord: ing to circumstances. Such undoubtedly was the law in capital cases prior to 1865. The subject of the death pe- nalty, however, had undergone much discussion. Its hu- manity as well as its expediency had been vehemently attacked and as vehemently defended. In seme States a repeal had been the result. In this State the Legislature adopted @ compromize measure. They gave to prisoners sentenced to death the privilege of cmeniog ‘an the Oyer and Terminer—including, of course, the Circuit as its substitute—to the Supreme Court, meaning the ge- neral term, and from Supreme Court to, the Court of Appeals; and as further lo ppg against the pos- sible mistakes of jurors as well as Judges, they ex- pre say authorized “the appellate eourt to order a new trial if it should be satisfied that the verdiet (against the sepgeony was against the weight of evidence, or against ; or that justice required a new trial, whether any ex- ception should have been taken or not’ in the court be- low.”’ (Laws of 1855, page 613.) The language of other parts of the act, although liable to some technical criti- cism, is bgp boing “Every conviction for a capital offence, &¢. 1 be brought before the Supreme Court Appeals, &c., by a writ of error, with @ stay of proceedings as a maiter of right’? Under this statute, as it seems to me, no discretion is left to Judge. He is absolutely bound, when applied to by any person convicted of a capital crime, to issue the writ and stay the execution. Of what avail would the writ be if the prisoner should be hung before his appeal could be heard? To say that he shall have au appeal as matter of right, and at the same time allow his life to be taken before he can reach the appellate court, would be a mere mockery. How cana man be heard when dead, and how can a man’s conviction for an al leged offence be reviewed on appeal without a hearing? Delay and uncertainty in the punishment of great crimes no donbt encourages their perpetration. the other hand, the judicial taking of human life ig and ought to be a matter ‘of deep solemnity. To weigh these opposing considerations was the province of the Legislature. The Legislature have said there “shall be’? au ap- peal; it is not for the Judge to say there shall not. In the present case neither the writ of error nor the stay accompanying it is likely to be attended with any evil. carried out till the 15th of January; the will assemble ten days before that time. A review can, therefore, be had, and a final decision obtained in the in- terval of suspension already provided for. The stay, therefore, which is applied for, will only be operative in the event of unforeseen casualty. Writ of error allowed, with a stay proceedings, till the Court of Appeals shali otherwise order. It is proper I should say that this dis- position of the matier ie made with the full the presiding Justice who heard the arguments at the general term. It is also proper that I should say, although, perhaps, it is not necessary, that the foreman of the first jury that tried Cancemi called upon me just as Thad finished my: written decision; he was apparently laboring under great anxiety of mind, and impressed with a deep conviction that the man is not guilty.
