REGULATIONS. All issues of fact already joined and triable in the city of Mew York, will be noticed to the clerk, aud be put on the ‘alendar for the ensuing January Cireuit. During the first week of that Circuit motions to correct We calendar may be made. After that week the calendar will remain unchanged, ard continue the culendar for every successive Circuit, wnti} all the causes on it shall be tried; cach Circuit begin- ning onthe calendar wiere the immediately preceding Bircuit left off, ‘Ywonty causes a day, and no more, will be called at general and special terms, and before each Judge at Cir- cuit, unless otherwise specially ordered. No canso will be set down for a particular day at a Cir- cuit, unless sworn off when called, on account of the ab- Bence of tness, and on payment of costs. If the trial of a cause shail not be moved by either party, when called in its order on the Circuit calendar, it will go to the foot of the calendar, and not be called again until it shall be reached in that place. Where the action is on contract, and the answer merely denies the allogations in tho complaiyt, without setting up apy new matter. 2 Where the acuon is on contract, and new matter is on up in the answer, and there shall be reason to believe that tht defence is made only for the purpose of delay. To entitle the cunse to be placed on euch calendar the Jaintif’s attorney must give a notice of four days, to be [eerd before a Judge at Chambers, that he will move to have the cause placed on such calendar; and if the motion granted, the cause may be heard on apy subsoquent is tho motion be founded on the belief that the defence is for delay, affidavits must be served at time of notice. ‘The pla.ntid’s attorney must deliver to the clerk of the Circuit a lke pm one day before such Friday, contain tog also the number of the camse on the general Circuit calendar.
