It further appeared that the alteration of the grade was ordered bj of the Gommon Council, passed on the 2 1, 1857, on the petition of claiming to bo ‘owners of property along the line of the new grade, which petition was signed by some twenty or twenty-tive indi- ‘viduals. It was clearly shown, however, that but few of the signers were, in point of fact, owners, the great being composed of mere tenants from year to , together with many boys and women who chanced be upon the premises when the petition was presented res. The resolution of the Common Council was din conformity with section two of chapter fifty-two ‘@f the laws ot 1852, which provides, amongst other things, ‘that it shall not be lawful for the said Common Council ‘to alter or change, in whole or in part, the ie of any street or avenue in said city now establis! south of Sixty-third street, except upon the written consent of the owners of at least two-thirds of the land $m Tineal feet fronting on each side of said street or avenue opposite to and adjoining that part theroot ‘the grade of which is to be changed or altered,” In this ease two-thirds of actual owners not having the petition in question, the plaintiff claims thatthe defendants were rs in altering the original grade of the street, consequently liable to him for the damages done to his premises by reason thereot. The Court held that although it was clearly shown that the Common Coun- el, by passing the resolution of the 20th April, acted ‘whhout authority, yet this Court had no pomenyeererss or review their proceedings. ‘That should bo upon ‘We return to a writ of certiorari. For these and other reasons which might be arged, juigment must be given for the defendants, ‘TNE COMPTROLLER COMPELLED TO PAY. Daniel C. Sturgis vs. the Mayor ct al.. of New York.— Me plaintiff was appointed third clerk to the Board of Gommissioners of the Central Park h the 4th of June, 3856, and was paid his salary ep the Ist ot January, at the wate of $1,000 per year, since which time the Comptroller has refused to pay him his wrges. The plaintiff claims Poe ‘up to Ist June, amounting to the sum of $438 13. ‘The defence interposed is, that the salary had never been ‘fixed by the Common Council, and also that_no appropria- tion had been made for its payment. The Court overrules ‘the defence, and gave judgment for plaintiff for $438 13 and costs. WHE COMPTROLLER'S OBSTINACY AGAIN OVERRULED. James Boyd vs. The same.—This action is broughtto re- e@over $429 50, the amountof a bill for repariring and fitting up the rooms occupied by the Court of Common Pleas. The work was done by direction of the Comptroller. He au- ‘thorized Mr. Jarvis, the Clerk of the Common Pleas, to Ihave the work done, promising to pay for the same. + Fer gome reason or other he has refused to do it. The defence ‘t this claim is that the Comptroller had no right or au- thority to order the work to be done, and that if he had, ‘@e amount of the bill being for more than $250, the work pec! have been done by contract founded on sealed or p ; ‘The Court heid that the Comptroller was the legal cus- tedian of all the property belonging to the city of New ‘YVerk; that the work in this case was done at several diffe- ent times, each contract for Jess than $260, and gave ,Jedgmemt for the plaintiff for $429 50 with costs. ‘Williamsbarg City News. Gillespio was driving along Maspeth avenue inthe Eighteenth ward, with alight wagon, his vehicle was run into by a wagon driven by @ young man mamed Maujer, and Mr. Gillespie was considerably injured Dy being thrown to the pavement. Officer Bennett ob- werving the occurrence came up, upon which young Mau- Jer ran away, leaving his horse and wagon behind. In the ‘wagon was found a number of hair cushions, chairs, a marble top table and 4 quantity of carpeting, which it was jucntly ascertained bad been stolentrem the Dutch Reformed church near Bowronville. The following morn- fag the horee was hitched to the wagon, and being et to go where he would, the officers were conveyed to an old unoccupied building on thy ‘Maspeth road, near the Penny bridge. Here the office @iscovered {nitications that persons were in the habit of frequenting the place, but no property was found except @ buggy wagon Secreted in the rear of Une buliding. The game day Sergeant Kggleston, with a posee of men made a escent upon a house at the corner of Lorimer and Withers mreets, occupied by an old lady named Maujer, and there found a variety of articles, such as remuants of goods, ladies’ wearing apparel, carpeting, crockery, ‘hairs, and various other articles which, no doubt, liad all been swlen, The old woman has three sons all residing there, two of whom she admitied had been engaged in ‘committing robberies for nearly two years past. Tt was also ascertained, from the residents in the vicinity, that the brothers Maujer had disposed of several thousand dol lars worth of property by auction, Some carpeting, chairs ‘and other articles were identified Saturday as having been stolen from a church at Hempstead last summer, These Dad been sold at auction to some of the neighbors for lest ‘than baif their value. They then tied his feet, and took turns Rg tim Hp) occasion- ally resting to ask him to confess; but he continued to protest his innocence until about five o’clock, when, he says, fearing that they would whip him to death, and they swearing that they would do so if he did not own it, he acknowledged that he had hamstrung the animal. He was then taken tothe house of one of the party, and, as he alleges, his body exposed in an indecent manner. ‘Terpenning’s wife followed the party, and was close by all the while they were maitreating her husband, Sho heard himcry and plead with them not to kill him, but dared not go to his assistance. After the whipping was completed she took his clothes to him. They dressed him, again tied his hands and feet, and fn this manner he was brought to Monticello. From the of the’ body he must have received from three four hundred lashes. His whole person was cut and bruised in a shock- ing manner.
