The Mayor, ds., of the Oity of New York.—This was en action in which the plain- {ffs sought to recover the value of certain stage furniture, fixtures and other articles, which they had erected in Castle Garden for the purpose of fitting it ap for public entertainments, on taking the loase of the Gardon from the Corporation, in 1844. Mossre. Evarts and Bowne, ap- peared for the plaintiffs, and Mr. Wilooxton for the Cor- poration. It appeared from the evidence, that in April, ‘1864, just before the lease of the plaintiffs expired, thoy commenced tearing down and carrying away all the im- provements which had erected in the Garden during be term of their le The lease provided that all the mprovements that the plaiutiffs might place in the Gar den during the term shozid beiong to the Corporation on its expiration.
