He said that it was almost reedless to point oue the duties of a Grand Jury. they ila 4 juined to be acquatn and, were it not for the require- mertsof the statute, there would be mo occa-ion to ebarge the jury; but, as the statute required it, it be- came imperative to inform them upon certain particulars. The Recorder then briefly a¢dressed the jury on the usury law jaw on lotteries, the election laws, the law on bribery. &c. With regard to the first named. although een almost a dead letter on the statute book, yet thereof should be presented as misdemeansra. ‘bitory law waa then touched on; it had already been passed on ia this Court, and was now betore the Conrt of Appeais—ove Judge of this Court had declared the law unconsti:utional, while another had declared the reverse; yet proveentions for its viclation could not be originated in thie Court, for, by an act of the last Legis- iature, the Special Sessions had ccntrol over all misde- mearors. If, however, the jury would find indictaents uader the law, the Court would ‘feel it his duty to have such indictments quashed. The Resorder then addressed the jury on the finding of indictments, recommending that caution should be exerc.sed, as they were really to a certain exwnt Zt guardians of the Fights of the citizen. It is in my epinion, said the Recor. er, hignly improper for the Grand Jury to find indictments ‘against parties, with the expectation that farther evidence then | that eubmitted to them woula be found to sustain the charge. It frequently eceurs that parties are indicted, and when brought to trial it turna out that there is no grounds on which to svstain a prorecution. The Recorder having charged the Grand Jury, the trial of Joseph ‘bling, the’‘Commissioner of Streeta and Tampa was then resumed. Dr. Geer, after which tha report of the Committee on Theses was read, which etated that De.
