NEW YORK HERALD, SUNDAY, AUGUST 5, 1855. 5 codfish aristocrscy, that the old fashioned two and three wtory attic and basement brisk houses were not ‘Dig and good enough for them. Now, mothing short of four story brown stone house, with a high stoop and @ finished basemeat—being five Amished stories— will serve, cvem though the fourth story be asempty asa Dallocn, save once a week, when a clothes line may per- bance be run through it, Bat although thie description of houses may furnish plenty of work, and profits, too, for architects and Duilders, yet nothing can be further removed from @enuine aristocracy than the people who buy and os- eupy them. The old blood aristocracy may be known Dy their motto—‘ More land and less house.” Watch one of there famillies in one of your modern four or five story 16.8 by 70 brown stone houses, jammed in slong aide of fifty more just like it, and each and all withent air hole or elbow room. Bah! Is such ® atreet, cam such a street be arintocratic? No, wever. Ibis just fit for what, like Bicecker and other ence fashionable streets, it ultimately will be—boarding and other houses, fashionable tenement houses,.on an extravagant scale. If you wish to make a street for the aristocracy, you must follow the motto above stated— more land and less house. The more land the better. Let there be scope for trees, shrubbery, gravel walks, Sewers, kc. Let the house be built more on tne ground and less in the sir, and let the lands:ape gardener have something to say a9 well as the architect and builder. Let the houses stand well back from the noise and dust of the street, with plenty of space between the houses. Build up a street in this style, and you have doomed it te everlasting gentility. It is it for nothing else. The Douses are not big enough for boarding houses, hotels, &e.; and, in short, there is #0 much of the whole value im the land, and so little comparatively in the house Proper, that nobody but a man of wealth {a able to owa and eecupy it. Important as to the Authority of Constables. FIRST DISTRICT COURT. Before Judge Green. Avovsr 3.—Mr. A. Nesbit, a constable elect of the Third ward, appeared in court and stated that the Court of Common Pleas had recently decided that the official bonds of the several constables of this city were informal in being drawn to “The Peo. fle of the State of New York,” instead of to “The yor, Aldermen and Commonalty of the City of New York,” as required by law; and asks the Court whether he has authority to serve process issued out of this court. The Judge said that he had no doubt of the autho- rity of constables to serve ead notwithstanding the informality spoken of. They are officers de facto. Having entered upon their duties under color of law- fal title, they must be obeyed, and their acts respect- oa, ant 1 ; aa of eer DOR: Ren pronounced a em in proper ing for that pur- poce. “Where there is Py lain. Tustin at on office without any show of , the acts of the in- trader will undoubtedly be void, both in relation to individuals and the public.” (24 Wendell, R. pp. 526.) But that is not the case here; they have been duly elected and sworn; their only omission is in the bond. Itis the duty of the several constables to correct the mistake in question without delay, in having a proper bond executed and filed; otherwise Pie ‘become liable to indictment for neglecting to 80, Personal Intelligence. ‘The King of Portugal, accompanied by his brother, the Duke of Oporto, and attended by the Duke de Terceira, entered Turin on the 15th of July, having arrived the day Defore at Genoa, on board the French imperial yacht the Reine Hortense, from Palermo.
