FINANCIAL AND COMMERCIAL. MONEY MARKET. Suxpay, Sept. 17—6 P. M. ‘The stock market during the past week bas experienced ‘Tost violent fluctuations. The bulls and the bears have each bad a turn at the bellows, and both have blown pretty strong their own way. Erie has been the great Fock upon which both parties have split, but the proby- Didity is that buyers heve got the worst of it. The infla- thon early in the week, produced entirely by certain @liques of speculators, who are large holders at much higher prices, and those who were foolish enough to pur- ebase under the belief that the advance was permanent, was brought about for the purpose of enabling the most prominent speculators to get out without loss. This rive ‘has been solely with such a view, but it could not be car rie@ far enough. We cauticned outsiders about it, and exposed the movement for the purpose of preveatiag parchases at prices which could not be sustained. The result has been precisely as we predicted. On Saturday, the 2d of September, Frie sold at 32 per cent; Saturday, September 9, 41 per cont, acd Saturday, September 16, 4136 per cent. Since Saturday, the 9th inst., the stock ad- vaneed from 41 to 49 per cent, and has fullen from 40 to 41% percent These fiuctustions are sufficient to show hhew it bas been moved, and they should deter outsiders frem touching the stock in"any way. The whole market has been influenced by the operations in Erte, favorably or unfavorably. Afew days since ull the fancies were moving up together. Yesterday they were all moving down together, and the probability is, that before the elore of the present week, they will all touch ‘mash'lower points, Independent of the causes which exist why cer- tain faney railroad stocks should rule much lower io market value, thefe are other reasoas why aa inflation in prices cannot continue for avy length of time, even ander the moat extended ard thorough combination, Our internal financial affairs are by no means ina favorable condition, and the fature is not free from wious apprehension. Our shipments of specie hay weached an alarming extent, and are l'kely to increase. ur home supply of breadstuffs is likely to ba sufficiently Emited to enhance prices for domestic consumption, and ut off our exportations almost entirely. While our ox ports im the aggregate will, without doubt, be largaly seduced, our importations are likely to be unusually dexge. Cheap prices for food in Kugland will stimulate Procucticnus of all kinds of fabrics, and as the manufac- turers on the other side generally look to this country for markets for all their surplas produc's, we shall probabiy find the present system of forcing sules throuzh our aug ton houses a fixed fact for more thaa one reason. Tne eountry at large is deeply ia debt, Jadividuals, com- panies, corporations and States are all involved, more or Jess, beyond their availeble means of psyment, and must undergo the process of coatrastivn aud liquidation ‘This-must tend materially to the, redaction of actual eonsumption, if not to the supply. Hardly a section of ‘the country hss been free from disaster. Freshets, panics, fires, drought, disease, hurricanes, blight, mil- @ew and rot, or something else destructive to life and property, have swept over the land, spreading desolation and despair in its course, and the effect upon the pros: perity of ell classes cannot be otherwise than of an un_ favorable character. Nuison, Creuit Judge.—1. 1 am strongly inclined to think that Aaight & Palmer, the charterers in this case, are to be deemed owners for the voyage; and if so, the purser of the abip, who was their agent, was competent to bind the ship for the necessary supply of coal at Por- to Bello; and this, although the person furnishing the supplies knew of the charter, and that aecordivg to its terms the charterers were bound to furnish eoal for the voyage. Upon any other rule the master or ageat of a verse) ina foreign port, in distress, would ofteatimes find himself unxbie to procure the necessaries essential for his relief; the voyage might become broken up for a | want of suppli ¢ the ship go to decay im port for want of proper vepairs. I have found no caso where this knowledge, on the pact of the person furnishing the sup. plier, or making repaira, under circumstazces stated, afiret the right of charge upom the vessel as secu rity for the payment, The right to charge the general owner personslly is a very different question. 2. But, admitting that the charterera were not owners for the voyage, and but hirers of the use of the vessel to ‘carry parse: «and freight, and that the general ovners had ‘the porsession snd navigation of it, the cherter party resting fo covenant, and not ina letting of the ebip, in my jucgment the result must be the same. ‘The proof shows that the ship was out of coal, and went to Bello—it msy be properly said, in distress—for «upplios, and without Which she could not have performed her voyage. Under such cireumstances, I canpot doabt but ‘that the coal, if procured by the master, would basome a charge upon tke vesse!, according to the settled mari- time law. It is true, the claimants seek to exonerate her, upon evidence by the purser, who was the agent the charterer, that he con'racted for the supply of oval, avd potthe master. Ov the sontrary, that the master repudiated the purchase for himself and the ship. “he master has tot been examines; the cefenca, in this re- , is allowed to rest upon the evidence of the purser. ‘coutrad cted by the captain of the coal ship, who the sale; and according to whose evidence all were given to understand that the vessel would ba to, in case of failure to pay the draft drawn upon Ha’ & Palmer. ‘be purser contraticts himself in tevessl psr's of his evidence, anc in other respects it is not caleulated to inspire confidence He testifies ia the firet ploce that Captain Thompson did not teil him, at the time he consented to take the draft, that he should look to the veasel if it waa not paid; but afterwarda is obliged to admit that he oid, He also testifies that he had sufficient funds on hand to pay for the coal, and for other ex: es of the voyage; but afterwards shows that THE TURF, nd N*™. I think the evicenceo Thompron entitled to the most credit, and aceordiog to that {he master of the steamer participated, or should ‘de regarded as participating, in the purchase, He was present when the contract was mace for the coal, and when the draft for the balance of beep oatareer money was accepted; and, accurdivg to the evidence of Captain Thempeon Ke agreed to aceast it only on the condition the ship should be liable if the draft was not paid at maturity, It is true the master wax silect, but the inference na- turally drawn, under the circumstances, must have beeo that be sequiesced in the condition. 3. ‘the whole of the proofs show that the sale was wae, and draft taken, io expectation, on the part of Capt. Thompeon, that the ship would be lixble for the balance of the coal unpaid if the draft yas not met at maturity. ‘This is not even contradicted by the evidence of the pur. ser. ‘That evidence secks to repel the effect by establish. ing the fact that the master gave notice at the time that the vessel would uct be considered as liable. On this point, in the absence of apy evidence of the master, I think that of Captain Thompson entitled to the mort weight, for the reasons already stated, according to which the credit was given to the vessel, J must, there. fore, reverse the geciee below, and decree that the ves sel is chargeable for the balance due for the coal, with reference tothe clerk, if necessary, to ascertain the amount, eee ied ADVERTISEMENTS RENEWED EVERY DAY.
