M. a fight took place near the corzer of Greene and Sixth streets, between a Bry, of Americans and Irishmen, which resulted in ‘ling of one man and the wougdiag of six or weven others. Mr. Cameron ran up stairs, and found that the fourth floor was all in w blaze. He could not go up any nearer than the third floor. FIRE IN FIPTY-NINTH STRERT, On the night of toe 3d instant, a fire broke out in a carpenter's shop occupied by a Mr. Harper, si- tuated ona lot in y-nieth street, near Second avepve. Tho flames from the shop canght a small frame dwelling and burned it down, belonging to Jobn Morrisey, who also resided on the same lot, in @ emall trame tenement, which the fire did not reach. The front bailding was insured for $400 in the Beekman Insurance Company. The evidence showed that but little doubt existed but that the fire wos the work uf an incendiary; the facts, how- ever, did not point sufficiently to warrant the arrest of any person. TIRE IN GREENE STREET. On the morning of the 2d instant, a fire was dis- covered in the cellar of a two story frame building in the rear of No, 163 Greene ctrect. The premises | Were occupied by Wm. H. Reed, on the firat flor, and a French family upstairs, named Jacquin. The evidence in this case showed that the Dre was the work of an incendiary; it originated in a small woodboure in the eellar, among a lot of kindling wood, duestly under tre bedroom of Mi. Reed, and so rapidly did the flames ascend that the Fren family up stairs narrowly escaped with their lives, ae the fines nearly out off their escape, by catch- | ing the stairs. It wus further shown that the col- | lar doors were open and that any person from the | street could have free access to the cellar. FIRE IN THE ASTOR HOUSE STORE. | On the evening of the 5th instaus a fire occurred in the store win cow of No. 1 Astor House, occupied | by Me. George T. Green x3 & gentlemen's furnishh | Sore. The evidence showed that tho fire origi- | nated from the articles in the window accidentally | taking fire from the gas burner. There were four burne.s lichted in the window at tne time, and a poffof wind ts supposed to have blown a handker- chief into the flame, and thns set the other articles on fire. Mr. Green estimated his toss at $579, The origin of the fire was evidently accidental. FIRE IN WILLIAM STRERT. On the 2d instant 9 fire was discovered at No. 162 William street, kept by Wm a Loarding house and barroom. The tive, in this case, was fonnd to be in betweon the lath and on the ceiling, just above the bar. Jt was extin uiehed with but litle damage. Supertor Court, Hovey, J.--Prior to the amendment of 1352, this court held that cither all the defendants mnat be residents, or all be personally se: ved within the city, to give juricdiction nnder the 324 section. (Delafield vs. Wright, Codo Kop. N. 8.123.) By that omendment, the words “or where one or mare of sever! defendants, jointly liable on contract, re side orare Pesaran y served with the summons with- in thoze cities respectively,” were acded. Io the present cage, the members of tho firm resided, and fhe business was conducted in Cincinnati, Odio. One of them died, and letters of admicistration have been issued to the plaintif’ bere. The curvi-e ving partrers, the defendants, continue to reside in Ohio; but one of them, being temporarily here, bas been serve? with a summons, in an action for & vettlement of the partoerabip affairs, an account and peyment. The objection to the jurisdiction is taken by ans#er, and the case was submitted at special term, 1 donot think that this is such a case of a joint liability on contract as the Statute intends, Tt proper to any that the right arises ont of the et ot partnerabip, and jr is posible that toe Tesult may show a joint liability of the two as to some of the property.
