Street rosa SUPREME COURT—GENERAL Ti Before Chief Justice ma Fentioos mee Roosevelt and May 15,—Drcmston.—In the Matter of the Widening of Wall stree—On the 4th of June, 1861, a resolution of | the Corporation of New York was aj Mayor, which directed that Wall street, on the northerly | side, between Rroadway and Nassau street, be widenet four feet, except that ‘intil June 1, 1860, the buildin, or ang part of it, on the corner ‘of Wall and Nassau streets, or of north side of Wall strect, should not be re quired by the Corporation to be taken down, but that the same should remain until that date as ‘t was at the | date of the resolution. In July of the same year a peti- tion was presented under the Corporation seal of the cit y, to the Supreme Court, at special term, for the ap- polstment ‘of Commissioners of Estimate and Assessment. At that time it was argued that the e: resolution was voi, and that opinion was expressed by the Judge then pre: No order on that subject was entered; but probably 10 conform to that opinion, the petition a8 now on ile and the order entered thereon omit the exception entirely. ler was entered 28th July, 1851, though dated on the 5th of that month, The Commissioners madé the necessary affidavits and took the outh of office on the 29th July and lst of August, 1851. The map showing the property to be taken s not completed until the 17th of Septtember, 1851, and \e map oltproperty benelitted, not until the 27th of Octo- ber following. The Commissioners then made a report and deposited it for examination on the 19th of December, and they, disregarding the exception contained in the resolution of the Corporation, reported on the lot at the corner of Wall and Nassaa streets, as if it was im mediately to be taken, and the building removed, and awarded to the owner of the fee for taking the laud, and taking down the building on the part of the lot to be ta- ken, and for loss of rent of that part from the Ist of May, 1852, $9,829, and awarded to tue lessees for their inju- ries from the Ist of May, 1852, various sums. Objec- tions were presented to their report, and, among others, by the Bank of the Kepublic, the commissioners, (as their report shows,) having allowed the bank the value of the land taken from it oly, and not the ‘value. of tho builaing upon it. The Dommissioners acted in this con trary to their own judgment, but under the advice of the corporation counsel. ‘The bank contracted to pur: chase this lot of ground with the buildings thea on it in January 81, 1851, for $110,000, and made the first jayment on the 22d of Februnry following Oa of May they cbtained po: f the lot, and began to pull down the old building; on the lath’ot the a1 month they made a contract in writing witu J. L. Tayl to do the carpenter's Work of their new building, ant to complete it by ‘he Ist of November, 1831. The browa stone masons were to complete their work by the 1st of Cotober, 1851. 7 ason made his contract <n May 16, and was to complete his work by the 15th of Cotober. On the 28th of July, 1851, the building had been erected as far the bavement; on th story: on the’ I7th.of story. The Gommissoners could hardly view the lands to be taken until a survey should show what was to be taken; and by the article under which they proceeded they were required, ‘after baving viewed the premises,” and ‘after causing sur veys, maps, &c., to he made, to proceed to make a joint, equitable estimate and assessment,’ (See, 178, p. 410.) By the 28th of July, when the order appointing the Com- missioners was first entered, the building had been erected to the upper partol the first story, above the basement, and by the 2ist of August, and before the Commissioners could ha\e begun their estimates, it was erected to the top of the third story.
