Carroll.—The decree made in this caso at special term in January Inst has been settled but not yet entered, and the Plant? ap- plies to have a new hearing that it may be settled anew. His very distinguished counsel express their conviction that there are provisions in some of the numerous in- structions to the referce contained in the decree whieh they could readily satisfy the court are. erroneous, selate principally to the question whether, ina bill against an executor for an account, his answers in genoral terms as to the account are to be taken ## true when the cause is heard on bill and answer replication only. In such @ case the cause is to decided in part on the proofs Lefore the court, and the court is to instruct the referee what facts are ‘already found by the court and it would svem that all that was put in issue, and could under the pleadings be proved or dispo: at the hearing, might be considered as matter whieh the court was to declare to be proved or diaptor The former argument assumed such a rulo, and was main- ly directed to show what was respousive to the bill and what was not; and the plaintiff ’s counsel concluded his argument by expressing his preference that the court should declare what fuets it found to be responded to the bill, and xo proved by the cotyndanit’s snawer es was no proof but that answer, its responsive al to be taken as true. (see Wend, 366, 3d . C4, 6 id, 32,1 Cow. 743.)
