Gentlemen of the Grand Jary—I know that you will pardon me for being so brief this mornirg, It will be my object simply to call your atteation to the state of the busioees affairs, and to caarge you on those matters which the law directs me to charge you upon. Ifthe Court shall try the cases faster than the Graac Jury shall bring them ia, thee the fault lays with you. Witness was here cross examined by the prisoners’ counsel as to the idestity of those who were arrested. John Morris deposed that he left Barnes and MeMeaus in a store in Thirty-second street; they caue home with me from thé house in Thirty second street, and that was all be knew about the affuir. Michael McGowan deposed that he was ia the dance house, but left it before the fight took placs, and came back after it was all over. Mr. Turner, beivg duly aworn, depoted to the general goed charactor ¢f cpe of the prisoners. Willism Dogherty deposed that he was sitting at his door emoking when the fight took place at Twenty third street. He asked one of the prisoners what the muas was about, but he did not anawerhim. Witness thought that they were fighting with the firemen, whom he heard was toattack them tbat night at the dance house Patrick McMirney depore? that he knew O'Neil since Pag a child, before he came to this country, but not since. Counsel for the prisoner—Have you known him since he came to this country? Witness—No, | have not. Councel—Thep I don’t want you. Gecrge Dixon depoied that he saw Grogan on the night of the riot at the corner of Twenty fifth street and First ave Hoe was standing peaceably, and was not in the muss at all, Here a host of other witnesses were brought up to prove the general character of the prisoners. ‘Hove the Cou't ordered the discharge ot William Bro- erick and Michael Walden, as the'testimony was not sirong enough sgainst them to detain them any longer. ‘The counsel representing each of the prisoners then summed the evidence for the defercs, which occupied tome two hours. At the conclusion of the defence, N B. Blunt, the Dis- trict Attorsey, proceeded to sum up the evidence for the prosecution contending, in the course of his remarks, than when more than :hree persons gathered together for the purpose of creating a disturbance of the pubiic peace they were deemed riotous, and gullty of the offence of riot. He claimed at the hands of the jury a verdict of guilty against, not only one, but all of the pritoners in court, because if even they did not partici- pate in the riot they did not go bome when requested to do so by the pole, and they were for not doing so aréed in the eye of the law as guilty of riot. He called to the jury to put stop to rioting, which has so ofven disgrsced this and other cities. ‘The Cours then charged the jury, and informed them that if persons who are at ariot, and when told to disperse ard go home by theanthorities, do not, they are in the eye of the law wgulity of the misdemeanor of riot. His Honor then requested the jury to bring in a formal verdict cf not guilty against’ Thomas MoGilli- gan.
