Anan, Aug. 31, 1853, The President of the High Court of Impeachment called that distinguished bedy to order at ten o’clock this mora- ing. Proclamation was made commanding silence during its preceedings, The minutes of yesterday were read. Some amendments to the journal of » previous day were moved by counsel on both sides, and atopted. The pre- ‘siding officer then announced that the Court was ready ‘to proceed with the trial. Mr. Porter, counsel for the managers, called James Brady as a Witness. He was on the stand om Saturday, and his evidence was not concluded when the court ad- journed on that day. He continued by stating that he tnformed Mather that he had lumber for sale which was suitable for the Troy docks; had « large amount on haad lying near the canal; had over ten thousand feet; he pro- posed to petition the Canal Board te build the dock, but Mather persuaded him not to do 80; he would have con- structed this work, and furnished materials, for a much sum tham was paid Rosevelt for lumber alone; he could have executed the contrac: for sixteen or seventeen thousand dollars. Mesers. Peckham and Reynoids objected to the inter- regatory. There is nothing of this kind ‘against respondent in either of the articies of imprachment. Mather 5 charged with certain traueacticas relating to the construction of the West Troy docs, whereas it is now proposed to travel out of the road sad introduce testi. pep relating to work which was not done, and is not yetdone. Besides, costeaded Mr. Reynolds, an attempt is made to mingle this affair with politics, and to inves- tigave Mr Mather’s pvlitica/Strapeactions since he has been Canal Commistioner. Surely this was not convened for any such purpo:e; nor is it likely that it will allow the doors to be o.ened for any such ‘purpose. We bave no objection on the score of politics, and Ps this witness is permitted to detail matters of this character we sbali zo into politics also, and show most conclusive- ly that political opjects lie ac the very foundation of this prosecution. Mr. Porter replied, that the only object of introducing the testimony was for the purpose of sho that Mr. Bracy wae prevented from duing certain work bessuse he did not conform to Mr. Mather’s wishes in obtaining the right kind of delegates to a county convention. Senator Wright (whig) deprecated the introduction of politics in this trial It opens a new view of the case: and tor the purpoce of giving the subject a fair conside- ration be moved a secret cc nsuitation of the Court. ‘The President put the qnection, and the Court deeided by a tie vote not the close the doors. A vote was then taken on allowing the question to be to 8) not to put the witness, and the Court decided (: allon the three were Bartlett and Uavenport, demo: erats, acd Clark, whig Managers bad no further question to put to Mr. Tue Brady. He was then cross examined at considerable length by Mr Peckham on the part of the defence. He had made €stimates for building the dock; could not give any de- tails, but they were mace in general terms. The witness was kept on the stand for an hour, but nothing ma- terial was eliciieé. Upon being discharged— Mr Porter said: We rest. Mr. Loomi» rove, and remarked that he held in his hazd certain depositions which he wished to read and of- fer inevidence. Mr Peckham objected; any deposition which you may have, made by Mr Mather.we will accept, but those made by other parties, whom we hare hsd no opportunity to examire, we certainly shall not consent to be introduced ag evidence a Mr Loomis sat dewn. At the opening of the court this morning Mr Reynolds, one of the counsel for Mr. Mather, opened the case on the part of the defence. He took in review the whole pro- ceedings in relation tothe impeachment case’ from the time the resolution was introduced in the House of As- sexbiy to the present time. He also dwelt at consider- able length on the cana] law of 1851, contending that Mr. Mather cannot be held responsible for any asts of omicsion or commission under that law because i: was nota valid one, His argument occupied about three hours anda half in its delivery, and, upon coaclusion, the defence Simon Sebermerhorn, who testified that there w: about two years’ supply of timber on hand upon his tion, No, 2; the price of that timber was thirty ni dolltzs per thousend ; does not think it could be pur- cbased for a Jess sum at present ; it was more expensive on account of being sawed tapering, for canal locke ; ibere is some refuse timber lying on the beuks of the canal which the State did not accept from the contract- ors ; it is necessary to keep timber on hand to have it seasoned and fit for use; all the timber not used is still on hand under the shed, except some we put on Mr. Rey- ncld’s fand. ‘Willism E Russell had been employed on the canal, and corroborated the testimoay of the previous witness, in relation to the quantity and price of the timber in question. [One charge against Maher is, that he paid extravegant prices forftimbe: used on the canal.) Martin C. Myers rworn—Is clerk for Superintendent; has seen Mather half a dozen timos at the office; knew of his having been frequently on the line of the canal when witness did not see him; the timber on the line was housed; went over the line every month; never saw any lay scattering; the timber was of the fir t quality; the only supplies on hand ia oak timber, having been obliged to pathic nos pine and hemlock during the year; Ma' travelled the canal in company with the Superintendent; the cendition of the canal on the seeond section will re- uire a large amount of timber—some ‘sur or five hun- rea thousand feet of timber—to put it in order. Mr. Peckham here acked the witness whether he real- ized any profit in fornishing the timber. Qbjected to by the Managers on account that the question was wholly immeteriai and irrelevant to the inquiry before the court. Question put to the court, and decided against putting the interrogatory. Witness made the contract for tae timber with Oathout, the then Superintendent, in the month of Cetober, 1851; the plan was a'tere! twice. This witness was croes-examined at some length by Mr. Porter, but nothing material was elicited. The hour of six erzived, and the court acjournei until io morrow morning.
