A Rey pe by the name of Horatio Seymour was called as a witness. His evidence placed it beyond the shadow of a doubt that the name ia the appli- cations for pardon, and in the order for the pardon which was granted, and consequently the name of the prisoner who was pard and whom he in- tended to jon, Was join, with an n, not je molre, with an re. "Bo that polst la seted. Here is the order for pardon. It was endorsed on the back of one of the petitions: — The petition for the pardm of F. B. Fé: ‘a, in Auburn prison. Grant pardon, H. SEYMOUR, The counsel for the people then attempted to up a side issne, in this roundabout way, viz:—| Rroving that he forged the spacey for his par ion, and that therefore the Governor's sympat with the unfortunate convict was not genuine, and that therefore his claim to the writ of habeas Scapos Waa genuine, and that therefore his ar- rest and imprisonment was genuine, and just, and right, and proper, Q. E. D. Accordingly, the officers of the prison were brought up, one after another, on the stand. There was the warden, and the agent, and the prison ere ae the keeper of the hame shop, and he keeper of the weave shop, and the contractor, and ihe District Attorney of Tioga county, &e. On their regular examination they were a!l unanimous that did not sign the petitions at- m, and that Edymoin was not sick, and that he might have torged the papers, because he had opportunities to write, and was a skilfal writer and engraver. But on cross-examination they were all equally unanimous, each denying that had ever given Edymoin any chance to write, or to get writing ma- terials, or had encouraged his writing, or had been at all remiss in watching bim. So, putting the two together, this testimony does not tirow a great deal of light anywhere in particular. The examination of these wituesses was continued through the day, yesterday, and all this morning. The court has now adjourned for dinner, but I re to say it is but little wiser than when it rose from breakfast. THE ARGUMENT CLOSED. (Telegraphic Vorrerpondeuce of the Evening Journal } Auburn, August 26—2 P. M. The evidence in the case of Edymoin was con- cluded yesterday afternoon at 5 o'clock, when B. F. Hall, counsel for the prisoner, opened the argument. He was followed by W. T. Worden and Attorney General Chatfield for the warden of the prison. James R. Cox, for the prisoner, and Christopher Morgan on the same ride, close the argament. Thie Sheet. the case was submitted to the court at about 12 o'clock, when Judge Humphrey stated that he would take the papers aud advixe counsel when he was ready to announce his decision. The mer was then remanded back into the custody of the sheriff, when the court adjourned. He led the life Philadelphia niggers are fond of—that is, pilfer- ing end running engines, antil he got bi enough to follow the more manly es , ‘aling. himself, at the age of manhood @ tall, straight, handsome, Adonislike darkey, “suitable for a hotel servant,” and kuowing that silver poe were plenty in these id houses, and would disappear without the lsndiord’s being able always to know whether they were stolen or thrown into the city slop-bucket, he let himself to the Frank- lin House, where he probably “ ie acquainted” with the editor of the HzxaLp. At this house, from seeing s0 many foreign gentlemen with moustaches, he imbibed the idea of cultivating some of that spe- cies of herbage himself, and the necessary convomi- tant idea of ‘“‘travelling.” Not being disposed to voy! as a private gentleman, he engaged the fri Columbus, seventy-four, Commodore Biddle, to take him to the East Indies, he mising in re- turn forthe courtesy of the Naval De in placing the ship at his disposal, to see that the vic- als of the Commodore were well cooked and ina state for easy digestion. Untuckily, however, a eat many little knisk knacks of the officers would ten to his palm in spite of all he could do, and Commodore Biddle, fearing he might lose his valua- ble services, kept him in irons for nine months out of the three years’ voyage. After valiag many ports in Europe in other ships, he set himself up for a Spanish gentleman, “ reduced by unforeseen mis- fortunes to labor for a living,” and opened a restan- rant. Then he married a very pretty Indo-Spanish girl of Panama, called Nina Al tamire, His restau- rant thrived, he put money in his purse, and finally leased a larger house, which he chriateued the “New York Hotel.” But William took to gambling, and gambling led to stealing, and stealing led to mur—— we don’t know what. Bnt one day he and the betrothed of bis wife’s sister went out gunning, and he came home without his companion. le reported that oung Gonzales had accidentally shot himself. It so Bappened, however, that the wound was im such a position that the coroner's jury could not be induced to believe the hole was made yy Gonzales’ own care- lesenesa, and Hance was thrown into prison, accused of his murder. Here he la‘d for some time, almost every- body being satisfied that foul play had tuken on the gunning excursion; but no proof could be ad- duced at thet time. Hance, it appears, was afraid some migh+ be scared up, 80 oné night he poisoned two of the guards of the Panama prison, one of whom, if not both, died. He was found guilty of the offence, and sentenced to the silver mines of C: thagena for ten years. Previously, however, he of: fered to azcuse some of the most respectable gentle- men in Panama of murdering the guard, but his offer was declined. He escaped from poe toaship in the harbor, and wert to San Francisco. It was in the time of the Vigilance Committee, and many members of that committee having had the pleasure of being robbed by him at his New York Hotel, shipped him back to Panama, and placed him in the hauds of the authorities. Personally, we can_ with zone testify te “his character and reapectabllity,” “ havi boarded at his hotel.” In 1850, we, in company Col. Fremont, Renator Gwin, Dr. Bowie and others, accepted of his hospitality. Landing at miduight from the steamer, and feeling particularly tired and sleepy, we prevailed upon Col. Hance to act as can- dlestick and guide for us to a sleeping dormitory. He was particularly attentive, took our trowsers, folded them up and placed them under our pillow to raise its attitude, mixed us an iced sherbet, and talked us to sleep. He even went xo far as to relieve ns of our puree, in which there was a doHar’s worth of dimes, and seventy-three dollars in gold. Having asserted in conversation with our friends, the da) before, that a man must be drunk to suffer his pocket to be picked, and not caring to back dowa from the position, and of course not having beon drunk, we said nothing about the theft—but in the course of the next day, saw the Colonel have a cu- rioua piece of gold in his hand, whieh we knew was in our pocket the night kgfore. Our brother, who was with ns, will also fy as to Mr. Hance’s “yespectability.” He placed some bags of gold dust in Mr. Hance’s safe for security, and Mr. H. either ecured @ portion of it, or else the ex ling dry atmosphere of the safe must have lightened it—for each bag, on coming out, weighed some four ounces lesa than when it went into the aafe. There are many travellers who have suffered in this howe to the extent of several thousand dollars each; and we believe that these misfortunes finally induced Mr. Hance to “ren mules” between Panaiaa and Craces, ‘Trunk-stealing about that time came into vogue. ‘Travellers can believe Hance’s story if they choose ; but if ever he shonld get loose, and get up another hotel on the line of California travel, if they stop with him they will wish they had believed onre. How Hanco got out of the silver mines into the State prison, we cannot conceive, unless the over- seers, knowing bis na rye fl » were afraid be would steal the whole mine.
