CLEVELAND, Aug. 1, 1853.- ‘The Association met this morning, as usual, in the basement of the Second Presbyterian Church, Prof. Pierce in the Chair. ‘The President announced that the first business ‘was the report of committees, Previous to these reports, the following gentlemen ‘were elected members of the association: —Dr. James R. This report strongly ondemned the custom of selling the volumes of the proseedings ata high, or at any price at all, and also the custom of collecting so large an annual fee from the members ; expressing the beliet that we had no possible need of funds, except to pay the permanent Secretary and the general incidental "Br: Govuy rewaried that it was the primary . E Professor Grsnes said that a committee of ten was desired to consider wisely the whole matter of the revision of the constitution. The Presipenr said they had come from the com- mittee unanimously, and were considered wise and important, or they would not be presented. Professor J. L. Sarr thought them wise. Professor Hani thought they were unanimously sustained. The assessment was among them, and the volumes should be distributed gratuitously. Prof. Bacus regarded it only as one of those mo- difications so necessary to a progressive body. He did not reflect on the past. It would reflect on him- self, We have advanced, and must change to keep up with the times. Dr. Gounn said, that as there seemed to be a mis- ot shop gaa regarding the resolutions, they had Detter be read. ‘They were read again. Mr. Reprizip wished it understood that even un- der these res. lutions it would be very long before the constitution could, or would, be changed. Prof. LeverinG thought the first resolution might be so modified as to relate to future collections, and that, as it now stood, it would reflect on the former administration. A resolution passed the Association modifying the resolution of Saturday last, which authsrized the Per- manent Secretary to purchase copies of the back volumes. it was so modified as to demand that he should furnish these volumes to the members of the Association at the cost price. Dr. Gippes now moved that the President ap- the committee of ten gentlemen to revise the constitution. The motion was carried, and the President an- nounced that be would make the appointment to- Jaorrow, as it required some time for reflection. The standing committee recommended calling on the Permarent Secretary, Prof. Baird, to make a fall report to the Association of his operations for the , and of all the moneys received, disbursed, and ow on hand by him. We believe that no report has as yet been made manifesting the condition of the treasury, which is paid to be unnecessarily full. The only necessary ex- jitures are for programmes, &c., for the sessions, stationery, and the salary of the Permanent Secre- , which is three hundred dollars annually. amie general meeting then adjourned to three o'clock this afternoon. A Sincuiar Case.—A Miss Read, of West Boyls- ton,(took chlorefori a few days ago, for the purpose of having a. tooth extracted, and after the operation was performed she was attacked with severe pain in ‘the Lead, became unconscious, and apparently died. Her friends supposing her dead, laid her out for bvrial, and began to prepare for the funeral cere- monies; but their grief was unexpectedly turned to joy and astonishment, on finding that the supposed dead began to revive. She eventually recovered the fall ion of her faculties; but what is still most pong in her case, as we are told, she suffers vio- Yent pains in the head as regularly as evening ap- hes, and at length, and about the same hour each night, falls into @ swoon, very similar to that which, in the first instance, was supposed to be the sleep of death. Cameron, being duly sworn, deposed—That he lived at 89 Christie street, he exemined the body of Mcs. Wall, ‘and gave his opinion tuat her death was caused by a rap ture of the womb. Whem he opened the abdomen he found the cavities full of blood, which showed that ferce had been used; on the left side of the womb he found a rupture, sbout six ince: in lenge which gave isaue to the biced found in the cavity. ‘The inflammation was so extensive that the intestines had stuck vo the womb. No such rupture could tal ithout a discharge of blood on whe part of the patient. Tae womaa’s stomach that the rupture could uot have nid the witness was cross-examined by the prisoner's coureel. Witness told the prisoner that he ought to send for auother doctor when he said ‘ if there were three more there they could not act aay better than be could.” Dr. Wilhelm was sent for after the prisoner gave up tbe operation, and he succeeded in delivering the woman im afew minutes. Dr. Cameron again took the stand, and testified that the way in which the prisoner treated her waa barbarous, =< bot legitimate. The puiling out of the arm was useless. Dr. Wilhelm, the Coroner, who delivered the woman after the unsucessful attempt ot the prisoner, was then examined, and testified to the condition he foun i the un- fortunate woman in adescription of which would shock the ears of all persons possessed of any degree of modesty, Several witne ses were then produced for the defenc: testifying to the great skill of the prisoner as an ai ceucheur. The counsel for the gefence then cunimed up the evidence for the defenoe, arguing that s man of skill, as the prisorer was, would never have caused the rupture of the womb, and that it must have been spontaneous or caused by Dr. Wilheim. The Assistant District Attorney, Mr. Hall, then snm- med up the evidence fer the prosecut' contending that the greater’the prisoner's ekill t! greater hia », while attempting to celiver the The Court then charged the jury, who after a few mo- ments consultation, rendered the verdict of “Guilty of manslaughter in the fourth degree.” Hicuer Law 1n Exre.—The citizens of Erie, Penn- sylvania, are in a state of great excitement, on ac- count of a proposition by the Lake Shore Railroad Company, to change the gauge at that place, so that the present delay and inconvenience arising from different fagites may be avoided. The alteration is abeut to be made under the authority of an aot of the last Pennsylvania Legislature; but the people of Erie are determined to resist the change ‘‘at all haz- ards and to the last extremity.’ They held a meet- ing on the 19th ult., and passed resolutions which, the Post says, amount to rank nullification, and are likely to lead to open war.” They say the law was procurred by bribery and corruption, and is not binding on them. They are determined to tear ap the railroad at all points where it crosses the streets of the city of Erie.. The wea Council met the same evening, and ordered the high constable to tear up the rails, and made it the duty of every citizen to aid in the work when called on, under a penalty of five dollars, and ese @ penalty of $100 for re- sisting the order. uly, they have stirring times in Erie. We hope the matter will be settied without bloodshed. Destructive Pirz at Farrrax Court Hovse.— A destructive fire occurred in the village of Provi- dence, Fairfax Court House, yesterday morning. The fire waadiscovered about 1 O'clock A. M., in the printing office of the Fairfax News. The office, with all its materials, was destroyed. The lower part of the bui'ding was occupied by Dr. W. P. Gun- nell, as a pbysician’s office, acd Wm. H. Dulany as a law office. Dr. Gunnell saved nothing—loss about #200. The books of Mr. Dulany in the front room were saved; those in the back room were destroyed. His loss is considerable. The flames soon spread to the adjoining buildings on either side. The law office of Wm. L. Edwards was burned, but most of the books were saved. Some valuable papers were lost. The building occupied by Mrs. Hunt was burned down—morst of the furniture saved. A build- ing next te this was burned. The buildings destroyed were all owned by N. Conrad, and were not insured. His loss is estimated at about $1,000. The principal Joss will fall npon the proprietor of the Fairfax News, who has, as will be seen, not only lost the material of his printing office, but ail of his accounts and books. This is the largest fire that ever occurred at Fairfax, C. H— Alexandria @azette, Awg.4. Snoormne Arrair NEAR ALLEGaNy, N. Y.—We learn that a murderous affair occurred near Allegany, about 10 A. M., yesterday. The circumstance, as re- lated tous, is as follows:—Mr. John Murphy, agent of Mr. N. Deverenx, went up tothe Chipmunk Creek e short distance, with a party of Dutch, to look ata lotof land. On their return they came toa spot where a fence had been thrown across the road, dur- ing their absence up the creek, which they at once proceeded to remove. While engaged in this work the party was fired upon three times by several per- sone concealed in the bushes near by. At the last discharge, Mr. Murphy was dangerously wounded in the head—a bullet taking effect near the temple. We understand that he lies in a very critical condi- tion. It seems that the men were civided into two parties—one from this city and one from Law- renceburg—and that bad blood had previously ex- isted between them. On Monday night the Law- renceburg party, having been discomfited in the first encounter, returned to take vengea: upon t! others. A terrible affray ensued, in which shovels, pickaxes, iron bars, clabs, &c., were freely used, ond the final result was three men killed, six badly and | | | probably liy wounded, and a large number of the remaind@ feartully cut up and beaten. THE Spirit Rappers’ Prorarecy.—An ividual in the town of Essex has, dur- ‘ing the present season, built a small vessel. After having finished her, he had communication from what purported to be the spirit of his deceased father, who informed him that he wonld not live six months after his vessel was launched. He imme- diately procured the assistance of several of his neighbors, loaded her on wheels, and with several of oxen she was drawn into the river at low water, and placed upon blocks, where she remained until high water, when she was afloat.
