Fetal, personal property, le act, her husband thereto, » as defend- not appear uy the return of the & material ques- @ admissibility of evidence. The case fe further return, on the coming on of which the judgment is affirmed, with costs ‘Kerney, appellant, vs. Guerney, respondent —In am ac- tion to recover which were stolen and sold to de- fendant’s wife, she knowing that they were stolen, the defendant, in the absence of any testimony to show any knowledge of the transaction, is not liable without proof of demand and refusal. Where s witness im: golf by admitting the commis-ion of larceny on several ocasions, evidence of his honesty on former occasions is ‘not proper to sustain his chatacier for truth. ws. Kl irgh —Where a person having amortguge upon persousl property on the premises, and ‘Sanignment of the lease as security, turned the same te defendaat vpon an agreemen* to pay the reat and taxes, ‘and defendant neglected to pay the taxes, held that plain tiff could pay the taxes, Gompel a repaymeat of thi same by action against the defendant—such payment was pot a voluntary be ment, which could not be rendered back. A party who's personally liable for, or whose pro- perty is subject to distress, for taxes, may, in default of the person who ought to make such payment, discharge the tax and comyel repay ment. Gowdier, appellant, vs. Carmack, —Defend- ants, in blasting rocks op their own lot, had no right to throw stone on the lot of the piaintiff, held by him ag temant, nor to extend thoir blast so as forcibly to split out the rock on the plaintiff’s lot, and to undermine the foundation of his house and render it insecure. Whether ‘this is done pogitgentiy, or by the use of all reasonable care, ‘he defendants are liable. The plaiatiff in such case recovers for the injury to his possession, net for an injary to the freehold; and may recover for any damages he sustained for an interference with his possession. O'Donnell, respondent, vs. Smith, aj —Where debtor underneath bill rendered to him by his creditor drew an order upon the defendant in terms, ‘' Please pay the above, and charge the same to account of P. S.;"’ and the defendant, upon the presentment of the bill and wrote thereon, $* I Promise to pay the above on or before Saturday, 22 Nev., 1851,”’ and signed it, held that such order was a bill of exchange, and that ‘the defendant's romise was not within the statute of frauds, nor void lor want of a considerati m expressed in the promise. Redd} , vs. Carpenter et al, appellants —In an action for work, labor, and materials, upon his em- ployment to do a particular work, th? defendant can neither et off nor recoup unliquidated damayes, alleged by him te have been sustained by the negligence or un- ilfulness of the plaintiff in the performance of other work, ifferent time and place. having no connection vie nor arising out of tue transaction to which the suit a order, 1e8. Sullivan vs. Brewster —The lien law, passed July 11, 1851, applies to cases where the contract was made be. fore ite Bassage, if the labor was performed or the mate- rials furnished afterward, and is not in that respect un- constitutional. The claimant must show thats payment has become due from the owner before he is entitled to reoover. A judgment of non-suit, or dismissal of proceed- ing on the trial, is clear to a second proceeding to onforce byte He Whe: dgment is obtained b: vs. Harmer —Where a judgment is obtained by default, and detendant shows that he was mistaken until the day of the return of the summons, such an error may be a ground for ordering a new trial. The defendant must also show that manifest iojustice has been done, and the mere affidavit of the defendant is not sufficient when the same is contradicted by the defendant, and of a witness who proves the claim. Where a defendant seeks to ob- tain a new trial, under such circumstances, he should, in addition to his own affidavit, furnish the testimony of a witness to establish bis defence. Tucker vs Gerahty.—Under the mechanics’ lien law, it is not @ partial defect in the notice to the answer to ap pear in proceedings to foreclose the lien that the notice does not state when the lien was filed.) Where a sealed covenant for the erec:ion of a building provides for such alteration and additions as the owner may direct, the wi of an addition or alteration is not such a consider- ation for ® parol agreement by the owner modifying the sealed imstrument as will make such parol agreement binding on the owner. e Meyer, appellant, vs Tienker, respondent —On a trial in the Justices’ Court, the Judge is not at liberty to in- duilge in loose speculation, with a view to do what he upon the whole may conceive to be equity. He must be governed by the evidence, and the rales of law applicable ‘thereto. Dewey, responilent, vs. Fisher, et al., appellant.—In this case, it is held that the judgment is’ not so far against the weight of the evidence that the finding of the court below ought to be disturbed on appeal. us. Domadi,—In an action for wrongful deten- tion and conversion of plaintiff's s, if an actual Yrongful detention is proved, no evi of demand by the plaintiff before suit brought is necessary, as the de- fendant’s original possession was lawful. ‘Same vs same.—When rent is payable in advance, the right of the landlord to recover for the period of the tenant’s'actual occupation after rent becomes payable is not defeated by the dispo-session of the teuant under the statute until middle of the quarter. Munse vs. Bosworth.— The evidence in this ease was suf- ficient to sustain the finding of the court below. Judg- ment affirmed with costs. Schwartz respt. vs. Bendel, appt —It seems a suflicient — for dismissing an appeal that the no*ice of appeal joes not state the grourds thereof, The court, cn appeal, have ne power after an appearance by both parties, and atrial below, to order a new trial upon the ground of vewly discovered evidence in this case, Judgment held not against the weight of evidence. igan ws. Hagen — Action for Injuries to Real Proper- ty.—When the plaintiff intermarried with his present wife, she was in possession of the land, her former hus- band having died intestate, leaving three children. She was im porsescion as guardian of her infant children. and that omasion continued after ber marriage with the plaintiff. He, though living with her upon the premises, not such & possession ax would entitle him to main- tain . His wife should bave been joined with him. ‘The husband and wife might have joined in the action, or the plaintiff might sue alone. plaintiff having recovered judgmeat in his own name for the injuries done. Heid, that the judgment be affirmed with liberty to the plain- tif, if he so elects, to amend the proceedings by the name of his wife. Such an action may be brought in the Marine Court, as possession is sufficient to main- tain it against @ mere wrong doer. No question of title is involved, unless the fact of possession is in dispute, which not being the case here, the Marine Court has ju- risdiction, all the Judges coneurring. Essildme vs. Weeks. —Sec 142 of the Code does not apply in the case of a note made before the passage of the code, but sueh a case is governed by the statute of limitations reviousiy inforee. ‘The case of Ward vs. Thomas, 7 Fare. "445, dissented from, three judges concurring. where the defence set up is that the cause of action did not accrue within six years, the plaintiff was not re- quired before the last aniendment of the Code to set up & new promise in his replication; that it did accrue within sx years was sufficient, and the question of the mere promise is matter of evidence. Ingraham and Daly concurring, Woodruff dissentin, Clark vs: Adcinson.—A complaint upon.e note merely, to which the defence is the statute of limitations under tae act, is good, and yet may imply a new promise. ere the defence is a-discharze in baun- Fuptoy, & new promise is only avaiable when made to the bolder of the note, and the same must be assigned to enabie any other party to sue upon it. Where the in- dorsee of the note to whom the new promise is made as- signs it and becomes # witness to prove it, he is am as- rignor within the meaning of section 399 of the Code, and the defendant has a right to be a witness to the same matter. Taggart vs. Roosevelt.—A parol agreement for renting real estate made for one year, to commence ata future time, igmot void under the provigions of the Revived Stat- utes reapeeting fraudulent convéyance. Where posses- sion ia taken under a parol lease void by the statute, it ‘enures as @ tenancy from year to year, and cannot de ter- minated by either party, except at the end of the year. ‘A parol » ent for one year, fo commence in futuro, ia vot void under the provision of the Revised Statutes de claring certain contracts void which are not to be per- formed within a year from the making thereof. vs. German Reformed Church —It is too late to object to the irregularity of an order of reference after the parties have appeared and proceeded with the refer- ence before the referee. It is no: necessary that the Judgment should be entered by the clerk. tedom ve. Jones & Quincy.—Where goods are sold upon an agreement to take a note of a third and deliver after receiving the note, 1! righty if the note is not paid at maturity, to return it and demand Peyment of the goods from the purchaser. Where the note is given by the maker to the payee upon & promise to deliver stock for it at a future day, and the passed the note to a third person to prece- Roe ase, or for a good consideration, the same might be recovered e maker, altmough the person to whore the note was transferred had notice of the promise to deliver steck for the note before he received it. Simonson. ve. | Meyers,—Proof that a dog had bitten keeper, and that it had been said he had bitten a person before, is not sufficient evidence to establish that he was accustomed to bite so as to render the owner liable. Munson 08, Reilly.—Where the landlord agrees with the ‘tenant to allow him certain privileges, in the use of Cro- ton water, the ard, woodhouse, &., and afterwards de- prives him of the use of them. an aetion may be main- ‘tained om the contract for damages therefor. Such a claim may be assigned and an action brought in the name of the assignee. Eliott ve. McGruckan —Where a master has knowledge ‘that_his apprentice, who is such,’employs a physician, and assemts to such employmant, he is liable for the ser- vice so rendered. A condition in the indentures that the master shall not be liable for such service if fot com municated to the physician would not, under the cir- cumstances of the case, relieve the defendant from lia bility. Fowler ws. Colyer.—The voluntary absence of the de fendant’s attorney to attend to other business for an hour after the time of appearance in the service of the sum- ‘mons, is not a good excuse for the defenee. Where an ap- ral is brought on a judgment by default, and the defen. t excuses the default, he must also show by affidavit that manifest injustice has been done by the judgment rendered, or the court will not order a new trial; an or- dinary affidavit of merits is not enough; the nature of the defence, if any, should be disclosed. ’ B vs. Conklin.—Piaintiff proved that he for defendant nine weeks ax car] was fourteen nhillings a day; that he was a good work- case rested, claiming $24 man, and upon this, prima facie, balance. ‘the defendant then called a witness, who swore Plaintiff waa peidin full at the rate of ten and twelve shillings day, which he saw him take and go away, as it to the witness, satisfied. Con: igned to Bowne & Curry, ‘The ship Arab, from Mat@nzas for Trieste, which run ashore, g Delta Shoal on the morning of the 13th ult, exceedingly perilous situation, and was re- liev most strenuous exertions upon the part of the wrecktrs, The vessel was brought to this port, and was taken possession of by Capt R W Welch, ageat of the bosrd of underwriters, The salvage awarded by the court war about 23 per cent of the valuation of the cargo, con- sisting of 2.600 boxes sugar, ke, the whole estimated to be worth $100,000. This make§ the salvage $2,500. The Arab sailed on the 19th inst for NYork, the underwriters agent coming to the conclusion that repairs were not necessary to be made here, the vessel only losing the whole of her false keel, and’ being only slightly hogged. The cargo is insured in Lloyd’s office in England, and the policy runs from a voyage from Matanzas to Trieste. The ship Luey has been refitted, and will be ready for sea about the middle of June. Some 1,900 bales of cotton have got to be stored. The salvage awarded upon the cargo saved from the wreck of the brig Cimbrus is 50 per cent upon the net amount, after deducting wharfage, storage, labor, and all expenses. This will give the wreckers about $5. on an average, apiece, for six weeks work. The divers in this care will receive extra compensation, to be deducted out of the amount received by the salvors. The schooner Northwester is in port, to sail for NYork ina dayor two. She is from the Spanish Main, aud has on board part of the eargo of the brig Mechanic, wrecked on the coast of Yucatan some weeks since, The railroad engine wrecked in the Cimbrus, and saved by the wreckers, has been sold by the U S Marshal at pub- lie auction. The engine was bought in by the underwri bois for $52,000—some $1,300 less thon the appraised value. The brig Potosi, from Cuba for NYork, struck on Crocus Reef on the Sth inst. She remaired ashore some time, but, starting her deck load, succeeded in getting off with: out further injury, and proceeded on her voyage direct.
