Messrs Medary, Meade, Gilmore, Angel, and (Crave of Maine, are said to be among the appointed. Official notice is given that the State Department is prepared te pay the third instalment of the Portuguese indemnity. The Criminal Court met this morning, and notified the Gardner jury that the Court was about to adjourn until ‘Wednesday, and if the jury agreed upon a verdict in the meantime, they might seal it and keep the contents to themselves. The jury returned an answer that there was no proba. Dility of their agreeing before Wednesday. The District Attorney moved that the remaining Ga:dner cases be postponed until the next term, in order to rroceed with the other cases on the docket. Mr. Bradley, on bebalf of the defendants, opposed the motion, and it was not granted The case of Johu Charles Gardner bring the next in or- er, will therefore come up next Monday. 1853. The Massachusetts Legislature. SUNDAY RAILROAD TRAINS—THE LIQUOR BILL, ETC. Bostoy, May 23, 1853, The House of Representatives to day refused to instruct ‘the State Directors on the Western Railroad to use their Gnfluence against the running of Sunday trains. They also rejected the bill for the appointment of a Board of Railroad Commissioners. The resolve for the erection of a monument to the tmomory of Daniel Webster was discharged from the orders of the day, and made the special order for to- morrow, at half-past 11 o'clock. A resolution was adopted, declaring that the business of the sesion can be completed on Wednesday. Ia the Senate, the Special Committee to whom was referred the liquor bill of Mr. Walker, embodying the amenéments rejected by the House, submitted two reports. The msjority report declares it inexpedient to Jegislate, and the minority that the bill ought to pass. Church Struck by Lightning at Lockport. ONE MAN KILLED AND SIX OTHERS WOUNDED. Borrato, May 23, 1853 } The Congregational Church at Lockport was struck by Aightming yesterday afternoon during servic». It entered ‘the gallery occupied by the singers, instantly killing Luther Crocker, one of the choir, and injuring others three of whom are ladies. Consternation and dismay weized on all the congregation at the sudden and awful event; and the Rev. Mr. Gilman, who, from the pulpit, Debeld the full effect of the calamity, fainted away. The hock was terrific, and its effect for several minutes ren. Gered every person powerless. The steeple was much shivered. The injured parties were much burned, but all | except one are doing well. Extensive Fire at Rockland, Me. Rock.ann,§Me , May 23, 1853. ‘This village bas been nearly destroyed by fire. It broke ut yesterday morning, at 3 o’elock, ina barn on Main Btreet, Thence it spread to W. A. Farnsworth’s store, end 8. Pillsbury’s building, and a fresh breeze springing wp, the whole ims few minutes were completely enveloped iin flames; and to the south the flames reached and des ‘royed the store of Larkin Snow, while to the north they Brept through two or three small stores, Spofford block, Zhe Commercial House, two large wooden stores, Diamond Dock aud Huimes’s block: thence they crossed to the op Pr-ite aide of the street,and destroyed every thing parallel ‘with the foregoing. I 4 t ‘ | from { wer ‘he Presbyterian General Assembly. Burvato, May 23, 1858. ‘Tho Assembly visited the Falls of Niagara on Saturday. Last evening, an eloquent discourse was delivered on Ministerial Education in one of the churehes, by Professor Smith, of the Union Theological Seminary of New York. His text was, ‘The harvest is great; the laborers are few.” The churches yesterday were all well filled. This morning, atter censiderable discussion upon the import- ance of the Assembly’s meeting in Pennsylvania next year, to elect trustees, so as to keep alive their corporate existence, it was resolved to hold the next assembly in Philadelphia. Dr. Cox, from the Committee on Bills and Overtures, presented several overtures condemning the fashion of dancing ; on the right of summary suspension of church members on account of absence; affirming the right of man to marry his niece; stating that though it is not desirable, it is not opposed to the Scriptures. It was resolved to print all the Moderators’ sermons, since Dr. Fisher’s, in 1837, A paper was read from the Presb; of Oswego, re- fusing to send a delegate to the Assembly while it con- tinued its connection with slavery. Considerable debate arose upon this, which was not quite harmonious. The Rey. Mr. SPEEs counselled the Assembly to be cau- tious, as many important Presbyterians who held on by & very slight tie, would be’easily thrown off by contemptu ous or hasty proceedings ‘The paper was referred to the Committee on Bills. The Rev. Dr. Hatrixip read a report, reflecting severely ppon the course pursued by a delegate from the New ‘York Association, at the Connecticut General Associa- tion, in endeavoring to prejudice them against the Pres- byterian Church. He recommended that the correspond- ence with the New York Association be withdrawn. The Rey. Huvry Warp Bxacuge replied, expressing fra- ternal feelings towards the church. Anniversary Week in Boston, ~ Bostox, May 23, 1853. ‘The anniversary week of the various religious and moral societies commenced to-day. There is w*large country representation present, and the meetings are fully at tended. From Springfield, Mass, FATAL RAILROAD ACCIDENT—STREET AFFRAY. SPRINGFIRLD, May 23, 1853. A fireman named Dodge was killed on the Vermont Valley Railroad, near Putney, this afternoon, while oil- ing the machinery of the locometive when in motion. He was drawn into the machinery, and the lower part of his body was torn in fragments before he was discovered. His remains were taken to Putney. i Homer Foot and Henry Vose, Ssqs., were assailed to- day in our streets by Frederick Dwight, whea a regular fight ensued between Messrs. Madame Sontag 1n Providence. PROVIDENCE, May 23, 1853. The Sontag concert here to-night was a very brilliant affair, the house being filled to overflowing. The enter- tainment is to be repeated to-morrow evening. Markets. Bautivore, May 23, 1853. The offerings today were 800 head of beef cattle, of which 250 were sold, and 400 driven to Fastern markets. The prices realized were $3 76 a $5 3114, on the hoof— equal to $760 « $103734 net. Hogs were dull at $7 a $7 50. City Intelligence. FATAL AFFRAY BETWEEN TWO BROTI®RS — ONE STABBED BY THE OTHER, AND KILLBD. last Saturday evening, a young man, twent: years of age, named Charles Clancy. residing at 86 Mulberry street, was stabbed with aknife by his own brother, a lad sixteen years of age, while in a temporary affray ‘in frent of*their own dwelling. It seems that the deceased requested his younger brother to go into the house; the latter, being at the time under the influence of liquor, refused to obey the demand, and Charles took hold of him to force him into the premises, when the other, en- raced at his brother for so doing, drew from his pocket a knife and inflicted a fatal stab in the body of Charles. The injured young man was conveyed to the City Hospi- tal, where he lingered until yesterday and expired. In- formation was given to the police of the Sixth ward, and Lieutepant Garrett last evening arrested the boy Clancy, on the charge of inflicting the ratal injury. The corooer will hold on inquest on the body this day. Kimball of the Boston muse- um, bought the red plush’ arm chairs in the parquette for $90, and Niblo bought all the plushing work, which cost originally $2,000, for $60; the same gentleman was the purchaver of the scenery. Tue Caroric Smp—Captein Hriesson has written a letter to the editor of the Commercial Advertiser, in which he says that the cylinder bottoms or heaters, which were originally of tin plate, are to be replaced by cast iron: the former material having been found too elastic.
