Howard & Son, *‘ being the owners in their own behalf and in trust for the libeilants,”’ contracted to sell her to the claimant. That agreement, dated November 18th, 1850, pu: to convey no more than “ the interest of J. Howard & Son in the vessel,” and there is no documen- tary proof in this cause that they owned the ship or held any part of her in trust for the libellants. The agree- ment of November 18th, 1850, reserved a lien on the ship to secure the payments stipulated to be made by the claimant. But it contains no conveyance of the ship to J. Howard & Son, by the claimant, in case those payments are not wade, nor does it stipulate a right on the part of J. Howard & Son to the possession of her inany case. If that arrangement, or the consideration upon which it ‘was founded, amounted to an equitable mortgage of the tl we an Serie sneaet be enforced 8 admi- ty by @ possessory action. The libellants not having shown a legal title to the ship, and proceeding on their right as assignees of the lien or eucumbrance claimed by J. Howard & Son, their cae is not within the cognizance of a Court of Ad- aqjralty, and the libel must be dismissed, with costs. Edward Knox vs. the steamboat Dallas, her tackle, &c.— ‘The steamboat belonged to this port, and was supplied with various apparatus connected with a steam engine, with a siew to carry out patented inventions for the Yr of vessels. The inventions, if penctioable, cid net useful, and the apparatus was abaadoned. ‘The lil waconalerst, by an agent of the owners, [being also. patentee of inventions and part owner of the veasel,] sud by the master, to furnish and put up the copper work, pipes, &c., connected with the apparatus ‘and steam engine. After the project of fitting out the ship with the engine and apparatus was aban- a the present claimant took the management of her, ‘had all the works removed, and the shi equipped asa sailing, vessel. He admits o part of the fibellant’s der mand to be payable by hum, and has always been ready to satisfy it, but the libellant declined to accept part pay- ment. e defence is that the equipment put upon the vessel in the first instance was merely an experiment by- the patentee, at hia own charge, and was no lien on the wessel, and utterly useless to her owners. Held that a mechanic is only responsible for the sufficiency of his ma- terials and work when supplied conformably to orders. The law does not impose on him a guaranty that they shall answer the ex tions or purposes of his employer. Thompson knew the pro- yeller was chartered to Haight & Palmer, and that the yursor was their agent, and bought the coal on their be- talf, The purser paid $1,600 cash towards the coal ; he Aud cash im hand sufficient to pay the balance, and so in- formed Capt. Thompson, but the latter took a draft on Haight & Beiner for $1,080, the balance of the purchase money. The purser testifies the captain preferred the raft to the cash, as he expected to go to New Orleans, The eaptain of the schooner testifies that he accepted stating to the master of the propeller at the he should hold him and the vessel liable for the coaR The purser swears the sale was made to him, sud credit was given to Haight & Palmer alone for the lance, and that, after the coal was delivered on board the progeller, and not before, Thompson said to Captain Baxter he should hold him and his vessel responsible for the balanoo, and that the latter immediately replied that neither he ‘nor his vessel had anything to do with the urchase. Capt. Thompson did not demand cash for the lance, but retained the draft, and gave his receipt of payment. Haight & Palmer had failed and absconded when the draft was presented, and it remaios unpaid, ‘The libellants offered it in court to be cancelled. pon the 's, it was held that the sale was not made on the eredit of the propeller or her owners, but for ready vash, in part, and for the residue on the credit of the char- derers, and the libel must be dismissed, with costs. Franklin estimated that it would reach $581,640 in one hundred ears, but owing to losses it will probably reach about ,000, One provision of the will was, that when the fund should amount to $581,640, half a million dollars should be appropriated to some public works, which should be judged to be of the most general utility to the inhabi- tants of Boston, The loans are now rarely applied for at all, and it is proposed that the fund be deposited in the Massachusetts Hospital Life Insurance Company and in the savings’ banks of Boston, The sum of $43 has been collected within three weeks iu three of the Boston schools, for the Washington monu- ment—the contributions placed in the boxes for the pur- pose, by the pupils. There was a better feeling in the stock market this ning, but the coal stocks have not partaken of it. ‘Travsactions in all the fancies were large, principally on time, buyer’s option. At the first board Nicaragua Tran, sit advanced % per cent; Morris Canal, 34; Canton Com pany, 1{; New Jersoy Zinc, 14; Erie Railroad, 1; Harlem, 3%; Norwich and Worcester, 34; Reading Railroad, 3; Hudson Railroad, 13g. Parker Vein declined 21¢ per cent; Phenix, 4; New Creck, 14. Cumberland remains about the same, Montgomery Mining is rapidly sinking, and wil! soon be entirely out of sight. The stock market has taken just the turn we anticipated and predicted. The depreciation yesterday was too great, and came too sud- denly, to continue. Most of the decline in certain stocks has been recovered, but we have not much faith in its per- manency—it cannot, in our opinion, be sustained. Even in the event of the money market becoming easy, and re- maining s0, it will require some time to give fancy stocks a good, healthy start upward. There is no disposition on the part of any one not already deoply involved, to enter into speculation, and those in would like very much to get out, even at a moderate sacrifice. We look for a dull market generally, for several weeks. ‘The receipts at the office of the Assistant Treasurer of this port to-day, amounted to $125,072 60; payments, $114,684 08—Balance, $7,008,919 50. The steamship Arabia, for Liverpool, to day, carried out $201,300 in specie, principally gold. ‘The Pacific Insurance Company have declared a semi- annual dividend of eight per cent. The following named banks of Philadelphia have just declared semi-annual dividends:—The Mecbanics’ Bank, six per cent; Kensington Bank, six; Farmers’ and Me- chanics, five, and an extra dividend of two per cent; Gi- rard, three; Western Bank, five; Southwark Bank, five; Manufacturers’ and Mechanics’, four; Bank of Northern Liberties, five; Bank of Commerce, five; Tradesmen’s Bank, four. At a meeting of the directors of the Llangollan Coal Mining Company, held yesterday, T. J. Waters was elect- ed President, in the place of Dr. Wynne, whose sorvices are rtill retained by the company as its Vico President. Some time since, this company stated that its prepara- tory works for getting out coal, would be completed by the Ist of May, but we have not heard whether they were completed or not on that day. The speculative excitement in Lake Superior Copper stocks, which raged so intensely in Bostona few weeks since, has entirely subsided, and shares are fast finding their proper level. The value of nearly every one on the list has fallen heavily, and the probability is that there is a much lower depth for them all. They have been enormously inflated, aud may go now as far on the other extreme, P It will be seen by an advertisement in another column that the Hudson River Railroad Company intend issuizg corvertible bonds to the amount of $1,000,000, for the purpore of raising funds to extend the double track, and other improyemente. These bunds will be ivsued in sums of $1,000 each, payable in 1867, bearing seven per cent interest, with coupons attached, payable semi-annually. They are convertible into stock, at the option of the hold- ers, any time within ton years after the Ist of May, 1855- Stockholders have the privilege of subscribing to those bonds in proportion to the quantity of stock held. The gross earnings of the Erie Railroad Company for the month of April, 1868, amounted to $423,076 56, against $320,822 96 for the same month in 1852, showing an in. crease of $102,253 6l1—equal to about thirty three per cent. Anew stock and exchange house has been orzanized in Wall street, under the firmof Drake & Bradford. The general partners are James M. Drake, late of the firm of Coleman & Drake, and formerly with Jacob Little & Co., and N. G, Bradford, Jr., also lately in the employ of the same house. The special partner is Mr. Edward B, Little, who has put into the concern a capital of $30,000. I have no doubt also that our trade with the Canadas has quad- repre or itupled within the last five years, and that it is now largely and constantly on the inéreaso ; and the same remark holds good as to our general trade with the great West, as to which we possess advantages second to thore of no other city in the country. CumBERLAND, Mp., April 28, 1853. magerenl | ina great measure closed my examina- tion of this district, I hasten to make you acquainted with the result. ‘That the present available capacity of the region has ‘een much exaggerated is a conclusion that forces itself upon me. Not that there is an actual deficiency in coal, bt there is such a deficiency in making it, practically available, In support of this opinion I will endeavor, briefly to give you the reasons :— ‘The means of transportation first attract our atten- tion. Whatare they? The Baltimore and Ohi» Rail- road and the Chesapeake and OhioCanal. These two are the sole reliance of the companies in the eastern portion of the district. The utmost capacity of the Baltimore and Onio road is estimated at three hundred thousand tons per year. This road having been so long looked to as the chief means of getting this coal to mar- ket, the companies have neglected to provide them selves with proper number of boats for the ca- nal, As a consequence of this neglect they are now in # great measure compelled to await the pleasure or the convenience of the railroad. Besides all this the heavy up grades upon the Baltimore and Ohio road, together with the searcity of motive power, have pushed tho road to its full capacity, and it is compelled, cr soon will be,) to choose between merchandise that is comparatively light, and which pays at the ratio of $8 per ton, and $1 76 ton for coal, than which they could not have a freight mere injurious to their track. ‘This consideration, also, must inevitably force itself upon the minds of the directors of the road, if it has not ‘already done 0; and as they have calculated that the wear and tear caused by coal was as little as that of merchandise, (which, to every practical man, is erroneous upon its’ face.) they will, from this reason, if they consult their owa interests, be obliged to make a different ment. In this state of things, what are the coal @mpanies to do? With very few boats, and with the limited and un- certain means afforded by the railroad, if they save them- selves from actual less they will do well. This position of affairs is doubtless bad enough, and ery annoying, but compared with the companies upon the Georges Creek, or the wostern portion of the district, it is favora- ble. Upon Georges have not the means of gettive one ton of coal to market. The Lonoconiog Railroad, which runs through the valley will not be in working order for two months to come, (that is as far ag any practical result is concerned,) and these companies have no other means. it what makes affairs worse with them is the fact that they will be unable to avail themselves at all of the canal, for it is not to be supposed that the Baltimore and Ohio road will be willing to play into the hands of its great competitor, the canal; conse- quently, as I have before said, the utmost capacity of the railroad’ being three hundred thousand tons per annum, and as this capacity is subject to prior arrangements le, and then have to be divided between the eastern and western interests, the portion of each will precisely what is the value and ported in be entirely too small for apy practicable business. This must be the position of the Georges Creek companies for years (if they are able to hold out against it ) New is will have tobe built, and entirely different arrange- ments be made, before they can begin even to pay their actual expenses. The fact which is self-evident is that all coal stocks in thin region are very far above their actual present value. - That they will ultimately prove profitable there is no doubt; but such profit, or success must from a far different system than that now in operation. The Boston Transcript of the 3d inst. gives the follow- ing statement relative to the revival and progross of the manufacturing interest of New England:— ‘The gradually reviving life and prosperity of the manu- facturing interest, in spite of the existing tariff, by which it has been for five years back depressed, is worthy of a somewhat detailed record, and to all in- terestod is a subject of triumph. The York Mills (Saco,) pay to-day 4 per cent, and the Boott Cotton Mills (Lewell,) the same on Saturday. Reviewing the pre- Ceding balf-year, which allows the return of one dividend season all round, beside the corupanies just named, the Massachusetts, Suffolk, Lawrence, Tremont, Middlesex, and Hamilton—all at Lowell; the Laconia and the Pep: perell (Saco and Biddeford,) Cocheoo (Dover,) Great Falls (Somersworth,) and Amoskeag (Manchester,) have several ave. the same dividend. at of the Merri mack (Lowell,) the last December was 5* per ceat, as had been the one preceding. The Otis, at Ware, (which during this long interval of general lan- guishing has held its own better than almost any other company,) has just paid, or at least declared, a di vidend of 6 per cent, the previous one in October having been 4. On the otter hand, there are a fow companies which have not yet made a visible start towards regaining their palmiest state heretofore; though of these there are some which the knowing ones regard as in a fair train of success. Three per cent was the last dividend of the Ap- pleton (Lowell,) Stark (Manchester, ) Salmon Falls (Som- ersworth,) Nashua at N., Dwight and Perkins, (both in Hampshire county.) Salisbury at 8. [We so class the last, becaure, although a 6 per cent dividend was made by them about the 20th of January, it is the only one paid for a twelvemonth back.] Tho Lowell Company at J., gave but 2 per cent ia January, and haye no: for some time exceeded that amount; in some instances passing it by altogether. The Jackson (Nashua, } Ohicopos fied.) Valmer and Thorndike, (both at P.») dividend the last year, and sore of them for a yet longer period.
