J » Mr. Laroque, expected to be able to say in a fortnight, on the receipt of answers to letters he had sent, when he would ready; but he would probably have to apply for a further tponement of some weeks. ‘The District Attorney, whilst inclined to extend all pos- nible indulgence even in a case of such itude, proposed to set this trial down for Wednesday of next week. He could seers Teseiee how it was necessary to send abroad for witnerses fur a case which occurred in our own midst. Two witnesses for the prosecution are confined in Prison one a lad about seventeen years of age, and his testi- mony is ef such a character t the % Attorne: not permit that that witves+ should be put ina 3 ‘tion where he could not be reached for the purposes of this trial. He (the District Attorney) understood that an application was made to admit one of the witnesses to and that the proposed bail w: the partner of the . It would be the duty of this Court to place t lad where his attendance can be procured. He pro- Posed to ret the care down for Wednesday next. The et~ is ready to proceed with it when the defence ie Mr. Laroaue again uryed the necessity for time to procure witnesses from Abroad. Mr. Giraud, the part- ner of the accu:ed, did spply to bail the witnesagg, be- cause they were in bis employ, and his business wa suf- fering by their absence. It would be impossible for the defence to be ready at so.early a day as the District At- torney names, ‘The Court thought the proper conrse to take would be ‘to set the trial down for Wednesday, and if cause is shown then it may be postponed; but it is further the opinion of the Court, that unle-s some good reason is shown for a postponement, that the trial must then proceed. The District Attorney then moved for an order against Robert Hilton, the Coroner, to compel him to give up all payers of which he is possessed in relation to this case. In making this application, he begged to say that he at tended at the inquest, and volunteered his services, which he had no reason to suppose were objectionable. On reacbing the Fifth ward station house with the Coroner, t¥ey found, for the first time, that the prisoner had been arrested in the room of the widow of the deceased man. He, (the District Attorney,) sent an officer to the room to search, and the result was, that he returned with @andbox full of letters, which the District Attorney deems highly important for this investigation. He ‘applied to the Coroner for the letters for the purpose of classify- ing them, and producing such as were proper, for in no instance would he allow to go beyond his own inspection such as were not necessary, but would return to the proper parties. The Coroner has taken upon himself ‘to select the papers, and he now moved that the Coroner ec to hand all these papers over to the District ey. Mr. Laroque said he was not counsel for the Coroner, but Mr. Hilton had informed bim that he had looked over all the letters, with the exception of two or three, and that they had no bearing on this case. The Coroner ehc uld be notified of this application. The Court granted an order for the Coroner to show cause, returnable in the morning at 10 o'clock. Ad- journed.
