Judge Beebe charged tho jury as to what would coxatitute a riot; the only ones identified wero Ham- lin and Judge, but if ‘hey thought Judge was asting in concert with others wt the timo the officer was struck, he would be guilty whethor he struck the blow or net The jury retired, and after some deliberation re- turped a verdict of guilty of assault and battery against Judge, and acquitted the others, They were accordingly discharged, aud Judgo, who is at large on bail, was directed to atiend on I'riday next. Grand Larceny —Ava Emanuol, a black woman, was indicted for stealing pooket book, containing $240 in bank notes, from Honry Ryckman. Lt sosm- ed the prosecutor, (a white man,) had accompanied the prisoner, on the night of the 16th of Oetober, to a house in Mott street, when, as he alleged, she had stolen the money from bis breast pocket. It was afterwards zecovered by the officer. Tho jury bav- ing returned # verdict of guilty, the court seatoased her to three years impritonment, and Judge Beebe regretted that he could not send the witaess | to the State prison at the same time. Pleaded Guilty —Samuel McDonald, indicted for stealiog a pump, aud other articles, from the steam- boat Amanda, on the 26th of October last, and Charles Herman, indicted for stealing a watch be- longing to Nicholas Lux, on the 24th of October, retpectively pleaded guilty of petit larceny, an BO senténced te the penitentiary for six moaths cacl Daniel Jones elias Marr, indicted for highway robhery and etealing a watch, the property @f Dan- iel Week, Jr, pleaded guilty of gravd larceny, and, having been previously ousidved wad sentenced to | the States priton for four years.
