Novy. 4 —This Court, which, during tho last-ro- ces#, has been painted, and made to appear somowhat cleaner than it has done for a long time, was oponed this morning, according to adjournment, and the business of the present term commenced. The calendar is light, presenting only forty-three new cases for the consideration of the Grand Jury. Of these, thore were for assault and battery, with intent to kill, 5; hem, 1; robbery, firat do; 4; assault with a slung shot, | ; forgery, 1; bur: rand larceny, 21 ; receiving stolen goods, lary, 6 ; f obta ere undor false pretenses, 1 ; sellin, obscene books, 1 ; and keeping Nore house, 2. From last term there remain indicted 19, of which 11 aro capital cases, and therefore triable in the Court of Oyer and Terminer, which stands adjourned till Monday next. In our form of govera- ment, happily, no such check was required, and it behoved them to see that on the other hand the grand inquest was not perverted to a means of op- pression on the citizons, by charging them wi criminal offences on exparte statements, possibly made from sinister or malicious motives. With this view he would recommend g cau- tion ere they indicted any one on their own motion. Where the matter had undergone a regular investigation before a magistrate, there was not, of course, the same dangor of injustice being done. In calling attention to the election laws, as required by statute, the Judge took oscasion to al- Inde (0 the all-absorbing topic of the late excite- ment, faving the time was one when they wero especially called upon to inquire into any offence against those laws designod as the bulwarks of our constitutional liberties, by preserving the purity of the system of popular representation. With these remarks they were dismissed to their labors. CHARGE OF FALSE PRETENCBS—ACQUITTED Samuel J. Propor, a respectable looking man, who was indicted in May term last, for obtaining certain goods of tho firm of Rundle & Van Kleeck, grocers, to the value of $5 (five dollars), in the pre- vious month of March, by means of a fictitious check, and whose case has been several times called up and casion wing been forfeited, surrendered to take An array of counsel appeared for tho defence, consisting of the Honorables F. A Tal madge and Ambrose L. Jordan, H. G. Wheaton (late District Attorney of Albany), and Jonas B. Phillips, Esqrs. ‘heir services, however, were little required, as Mr. es B Rundle, the only witness called to the stand, failed completely in his proof, not being able to remember, even, what tha goods obtained wero; and the prosecution was npceeely | eee) and a verdict of not guilty rendered, under the direction of the Court. The most active fancies in the list were Eric and Cumberland, but prices were mot sustainod. It heavy market, and that lower prices will rule. There will probably be exceptions, and speculstion may tak® hold of some particular fancy, and carry it rapidly up; but that stocks generally will be neg/ected, and a depre- ciation be realized, there is, im our mind, very little doubt.
