The law which was always tender of the formal liberty of the eitlzen, required that such demand be made before he could be aitached and imprisoned ; but instead of such attachment, the party to whom interiooutory costs are pow awarded, collects them as he would collect a judg- ment. except that no remedy is given against tho real estate, As I read the etatute, he must issue a process, re. citing the order or proceedings which awards him these srbitrary costs, either literally or in substance. and eom- mending the sheriff to levy andattach the amount out of the party agaimet whom the costs are awarded. The process isin the nature of a fifa note, for iu the nature of pv sttacbment. In cases like the present, where the order of the court fixes the emount of the costs, and limits the time for payment. and the order has been duly served on the attorey. and is not appewed from, this prooess and thut may irue asa maitcr of course. and without auy further direction of the court. 1 observe, ou looking at the process in thix case, a copy of which is among the papers handed me, it directs the sheriff to make the amount out of the real estate of the defendant. on failure to moke it from the personal estate. This I took away. as the process should issue only against the personal estate. But this objection was not made by the defendant in the argument. The process may be amended in this respect if dermed necessary; in other respects it seems to be right as it reoltes the ance of the order. The motion to set it aside is denic ut without costs. Supreme Court—Special Te Decision by Hin Judge Mitehell Serr 28.— va the Protection Insurance Company.— The plaintiff obtained a commission to &t. Catharines without a stay of proceedings—having neglected to apply for it in due time. On the Sth of June last the cause having been reached on the calendar. and the commission not returned, it was ordered that the suit be dismissed with cots. unless the commission should be re- turned and filed on or befere the first Monday of thie month. It is not returned. The plaintiff bas not written to St. Catharines since the order was made. or done anything to expedite the return of the commission. He swears he had before paid £25 for the fees of tbe commissioners, and has since paid £25, and that be daily expects the return of the commission. Strictly, the defendants are entitled to have the suit diswis pursuant to tho order made and ¢ their costs in the suit as @ conse- quence.
