McCLENACHAN, Deputy Clerk Debates in the Common Council, BOARD OF ALDERMEN. OUR SPECIAL REPORT. Last evening, both Boards of the Common Couucil commenced their business for the term. in the Boata of Aideriuen ratuer a flare up took place between the alder man ofthe third wardand the Alderman of the Cwe Ueth, respecting a report made by the Police Commitie fn resobution attarbed recommending the payment 5 todobn McKeon, and the same amount to A. a. for coun-el foes. contracted in the defence of Phillips, two policanca of the Twentieth ward, ogainst whom an wd tmenu had been found on the complaint of Jumez P, However. previous to the report being called erman of the Third. offered a resolution authoriz Sixth and Fighth avenue railroads to cuntinue ir rails throvgh to Barclay street, Alderman of tie © and stated that he would vote for the resolu- on provided thcy would recommend that Robins strect be cut ihrough to Park place so that che rail cars could come to Kroadway. The resolution was referred. Ald Banu of the sixth ward. presented a resolution and reference to committee for the purpose of presenting a stand of colcrs to the remaining members of the New York Regiment of Volunteers, and to have inserived on the same the names of the batties they so successfully sed through during the eampuiga. ni of the Fifeentn moved to have the The at the Generals added to the inscriptions. ce olution was referred to the Finance Committee. Alderman Pres, of the Cwentieth ward. called up the report for action, stati at the Counsel had deteuded the policemca who had both been acquitted in the the court. and now moved to have the resolution adopted Before, however. the resolution was submitted, Alderman SreKTevant. hird ward opposed the adoption. Said the alderman, it had better be re ferred and examined. before we establish here a prese dent. Icannot sce why two policemen should be per mitted to employ private counsel and then come ia here and ask us to pay them itis nolo much for the amouat because it weuld be saving much trouble were we to it, but ifwe are to sit here and sanction such proveediy, et on example that may call tor action on such re every Week, Here we bave a charge of $25 distinguished counsel. aod fa ! why for defen wo policemen. The proposition is monstrous. and if we pay tbis we may be called every week to pay such charges, There is no law authorising sueh payments. The corporation attorney is the proper person to defend all suits ogainst the city; he gets paid for such services Chere ix no evidence that amy application was made to him in this matter, but the idea ot putting $250 into the pockets of these counsel is ont of all reason. Both the counsel, I copsider, are friends of mine. and I should te very willing to put a fee into their pocket could I do it consistently with my oath of office; but Iam here for another duty: Cam here to protect the public purse. and L cannot vote for th: tage of the resolution Aiderman Prox. in reply to the Aulermanof the Third ward. gave a brief history of the case 1 cau readily Fee. said the Alderman. the feeling in this matter Mr Gage is a very influential whig politician of some means, and the two policemen. Hannigan and Ureamer, ate demo crats. They weli knew that by going to the corporati counsel they would stand but very poor co as that gentleman and Mr Gage were on ve mate terms, end both of the same polities. I reo sleet, said the alderman the night of the aff Mr Gage was. on that occasion; laboring under @ spiritaal excitement. as many of us have been. (laughter ) and was on his way home, When he got into some «quabbie with a man named ». and Policeman Creawer came up to separate m. when Gage struck him a blow on the head with a heavy cane, and the Policeman returned the assault with hiselub, An alarm rap was given and Captain Hanne gan came up, told Mr. Gage who he was, and placed his hand on him, when Mr. Gage suddenly seized hold of the capten's two fingers got them into his mouth. and inflicted a very serious bite, Other assistance was procured, and all the parties came to the station house. The whole affair was laid before the Mayor. and en the facts. the Mayor would notentertain any charge against the policemen but con sidered that they only acted in the Roope of their dut Mr Gage, however. not satisfied with the Mayor's di ion, went before the Grand Jury, and fy ‘te oe porte statements, procurrd an indictment charging the police- men with an aeeault and battery, and attempt to rob. The matter was brought before the Court of Sessions and dismissed, and now it is but just that the counsel fees should be paid. The Aidurman of the Third—I do not pretend to say but all the fucts are correctly stated by the Alderman of the Twentieth. but I contend that the corporation coun se] should bave been applied to. and if we pay the charge. we establish a precedent, thereby’allowing the police to caoploy their own private counsel, when the city are pay ing the Corporation Attorney some $10,000 a year for such rerviees: ‘The Alderman of the Twentieth—It is nothing more than a party proseription, and no doubt it would please the opposite party to have bad two democratic policemem sent to the State prison; they would, no doubt, have made € — out of it. jere the President tapped bis hammer to order. Alderman of |the Third—I deny any political views in this matter, I did not know the politics of the policemen, but I presume them to be democrats, from the sentiments of the Aldermen of the Twentieth. The whole matter ie out of order. An application should have been the corporation counsel, and then if be refused sheen, make the application to the board for relief. Alderman of the Twelfth—I dislike to exhibit a prece dent in this matter, They should, I think, have made an application to the corporation counsel. 'y this time a considerabte sensation was manifested amongst the members, The reolution was submitted, and when itcame to Alderman Peck he said he should vote in the the negative. for the purpose of moving a re ie vote stood, seven for the adoption, Creemer and Walter Savage laid on table August | and eight against it 1862, which was carried.
