Upon the proof, this objection is overruled. The case on its merits mects with very contradictory statements—on one side going to show that the boats were weil built, of good materials. and in all respects in compliance with the contract. Onthe other side. the testimony goos far to show that both boats were badiy built; that they were wruk, made of bad materials, unsafe, and waseaworthy. If the cause stepped here. it might be impossible to say | where the truth should be found. and where justiee could be applied — But there are two most important cireum- stances upon which we can reply with safety, and when put im the seale, decide the controversy, One is. that the master who ordered the boas was at the yard nearly every otber day while the building ‘of the boats was in progress, and thus had a full opportunity to eee and exainine all the materi- als ured and ihe workmanship applied, down to the time when the boats were nearly completed. After all these opportunities to know there faets, and knowing them. on the 20th of April, 1850. the day previous to the sailing of the bark, he wrote and sent to the libellanc the follow- ing cciomunication in regard to the boat, concerning which the principal controversy bas erisen:— New Your, April 20, 1850. Mr.€. L, Ingersoll—We want you to have the square stearned boat sent down to the bark Cabargo, pier 6, Enst river, this day, as she will sail out tonigat. JOMN E. BARSTOW. As already intimated, this ease must tura on these two important faots. und the Court is thereupon eatisied that after ruch omple opportunity to inspect the mate- rials and wersmanship of these boats, and after this last act of his in ordering the long bout, when finished under his own eye to be brought downto the ship, it fetoo late toraje the objections et up in bivanswer. ‘The libellant isentitled toa decree with a rcerence. aud the rule of dameges murt be the aetual loss of the libellant after the sule of the two boats, with interest added to that loss, fiom the 20th day of April. 1 Superior Court.
