more agreeat i telegraph than to produce = ei the rules cf law upon the subject were entirely settled, ‘and there was no doubt upon them—and he ¢ould ‘not se that their neglect to assent to this should o-use this testimony to be excluded, Nor did he see anything in the affidavits in answer; and they would all recoliect the patience and essiduity with which he had read them; ind not only read, bur. in imitation of a distinguisbed character, be had asked for more. He had read ber Qérs. Porreet’s) affidavit, and ber protest against the ‘application to the Legislature of Peansylvania; and he had proposed to read more, until the plaintiff's counsel said there was nothiog but a letter or efidavit of Jamieson’s. There was no suggestion that Mrs. Voorhies’ letters were {iportant—tout was reserved for this morning—there was not the remotest allusion that Mrs. Voorhies bad ever made an affidavit He thought the rule of law was thoroughly established that the admission of the parties was at all times wod anywhere admissible. She (the plaintiff) of course do- ied 6) acts of adultery—that she had done under oath, im her cemplaint in this sction—and if the Jury believed ao they would not believe the defendant's testimony. bed been asked why they did net call the plaintiff eetand. They had, he suppssed. a right to do a0, and to examine the defendant (under the code) #9 far ‘as the Court had ruled they had aright ; avd when they ned eveh confidence in the plaintiff's trath as they (the plaintiffs connee!) had in the defendant’s, they would fertainly place hef onthe stand, (Suppressed laughter. ) ‘The learned countel then read several extrects from Mrs. Forrest's protest, where she spoke of ‘the said Consuelo letter,” contending that this was not otherwise explicable than by referring to Mr. Forrest’s affidavit, in which the “said letter was ret forth—for, acci- dentally, that letter was nowhere set forth by her in ‘words, and, however innocent and pure it was, the Court ‘would see the extraordinary efforts that had been made to keep it out from the Jury. The learned gentlemsa (Mr O'Conor) be could not but feel had departed from the original rule laid down by the Court for the disposal of any question which might arise—which was, that the party opposing should have the reply. He had dwelt very faintly in the opening, and had gone very fully into the summing up of the whole case. In conclusion, be ubmitted they weve clearly entitled to read the por- brs of the affidavit he sought to read; and in regard to those parts of it which were denied, (as suggested by this associate.) they were entitled to prove what par- ticular parts were denied, and that they were entitled to faleify those denials by’ showing that the statements ‘were true in fact. RONKY MARKET. Farpay, January 2~6 P. M. ‘The stock market opened a little more buoyant this morning. ‘Trapsactions at the board were only toa moderate amount, but prices were a little better, and there is evidently a feeling of comfidence taking the place of doubt and distrust. The opening of the new year has been of an auspicious character, much more so than was generally anticipated. This looks well, and perhaps brighter days are near at hand. ‘The large arrival of gold dust by the Cherokee from Chagres, removes, for the present, all fearsand apprehensions relative to our | supply of epecie, and gives usa pretty good margin for future shipments. This will undoubtedly have a good eflect on the stock market. There is a good ba- sis for speculations in certain stecks, and those who discriminate properly in their operations will, without doubt, make money. Several leading fancy stecks rule low. A close examination of the list, will enable cuteiders to make judicious selections, which, with careful caloulations, moderate purchases, with unlimited means, will give spaculators for a rise extraordinary advantages. The season is fa- vorable for the bulls. Our advices from California rela- tive tothe mining products are of the most favorable character. The large receipts of gold dust show that the quartz mining machines are in successful and exten- sive operation. In a short time our supplies of gold dust from California will not depend upon the séasons. Rain or the want of rain will make no difference, Arri- vals of gold will not only be more uniform in amount, but that amount will be much larger than heretofore. As enormous as the production has hitherto been, it is our impression, created by recent accounts from the mining regions, that the gold product this year—1852—will ex- ceed any previous one since the first discovery of the metal! in California, This must have an influence upon the minds of speculators, and it appears to ue that it cannot be otherwise than of the most favorable charac- ter. From Europe, the intelligence by the steamship Africa is, both ina political and commercial point of view, im- portant, interesting, and encouraging The coup d'etat coutinues successful, and, from present appearances of the political horizon in France, the permanensy of the position taken by Louis Napoleon is pretty nearly set- tled. The effect on financial and commercial affairs has thus far been of the most faverable character, not only in France, but throughout the Continent and in Great Britain. The guarantee of stability and solidity in the different governments of Europe, is all that capitalists, and the manufacturing and eommercial classes, require to extend their operations, and givea great impetus to every branch of industry. There can be nv confidence,‘no feeling of safety where there are sudden and frequent changes in the form or head of the government; and ifthe form and head are changed by violence—if revolution follows revolution with the rapidity realized in France, capitalists and business men of all grades will hesitate Jong before involving themselves in any enterprise which requires any length of time to develope and produce desired re- sults, This is why the movement made by Louis Napo- leon is so popular among these classes. It is a guaranty of strength and permanence in the goverament of the country, which has heretofsre been so prolitis of political revolutions. ‘The variations in quotations for stocks to-day were not of much importance. At the first board, Erie Railroad advanced 11; per cent; New Jersey Zinc, 1!/, with exten- sive sales, principally for caeh. Several heavy capitalists have, for some time past, been quietly buying up this stock, and they now control the market. The resources of the company will not be rapidly developed, and there is very little doubt but that they will prove much greater and more productive than have been anticipated. Hui- son River Railroad went up 1 per cent; Norwich and Worcester, 4; Sussex County, 5; Erie Bonds, convert ible, 2. At the second board there wasa slight reaction. Exie Railroad declined 1 per cent; and New Jersey Zine, Si. ‘The recejyts at the office of the Assistant Treasurer of this port to-day amounted to $7112 84; payments, $34 620 82; balance, $1,285,076 06; amount of interest paid to-day, $566,000.
