OUR WASHINGTON CORRESPONDENCE. Wasmixozon, Jaly 1, 1832. The Claim of George A. Gardiner. ‘The following is the opinion of the Bourdon Claime against Mexico, im the case of Dr. George A. Gardiner, the opinion of the Board will possess some interest :— Boann or Commissioners on CLaims against Mexzoo, Manon 12, 1850, The claim of George A Satan te Joss of oonsequent on his ex; from Luis Potosi, in Mexico, oetaban 1846. In pursuance of this order of expulsion, the present claimant was driven. out of said Ktute, and forced to depart, by a body of of Mexi- cun troops, who, after expelling the claimant and ing his property, ret fire to and destroyed his b ; thur stripping him of all his property. By the treaty of 1631, art. 6, between the United States and Mexioo, itis expressly stipulated that, in the event of a war between the contending parties, the eltixens of either nation cording in the territories of the other, and en- gaged in any other trade or profession than that of & merchant, “shall be permitted to remain in the uninter- rupted epjeyment of their bberty and property as lomg 4s they conduct themselves peaceably, and dO not com- mit any offence aguinst the laws.” ‘The elaimant was, therefore, residing in Mexico under the guarantee of forth im the treaty of 1831, and en- @ citizen of the Unitea States, to the full benefit a co, & due regard must be had to the motives which appear to buve influenced the public authorities of Mexico to put an end to such right. It is not to be pre- sumed that either nation, by any article or stipulation of the treaty of 1631, intended to deprive itself of taking a reasonable mexsure of precaution against wn injury likely to result immecintely from the residence of the citizens of the one nation in the territories of the other. ‘To sup- pose the contrary would be to aeknowledge that, by the taid treaty, cach nation bad stipulated against the right. to iteelf of self-protection, A reasonable cause of appre- hengion that an injury to its own seourity and pretestion was likely to arise from the resideace of the ottisens of the one nation in any particular part of the territories of the other, in a state of war between the two — would justify @ proper precaution or prevention Sgainet the possibility of such au injury. ‘The right of a eltisen, therefore, violated under such ciroumstaucas, sould not be considered us wantonly or vindietively done; and, under the treaty of 1831, ue would be entitled not to vindictive damages. but to such only a resulted imme- diately from the i of the agents of the gow It appears, from the evidence in this case, that the e: pulrion of the present claimant was not vindiotive or in- sulting, but thet he and ail other citizens of the United Slates, resident im the State of Sap Luis, were ordered to leave, beea towards that State, and were then in the posession '* the neighboring ftate of New Leon. If a reasonable time had beenallowed the claimant to make necessary arrangements for the reeurity of his property, prepara- tory to bis leaving the State, he might have had little catise to complain; but no such time being allowed him, but, on the contrary, being compelled to abandon his rruption of sueh rights and the acta meat earrying out its orders, the annics of their country were marobing we is entitled to in- ber +o Signed CALEB B. 8M. , > Comminioners, ’ J ROBT.T PAINE, {From the National Intelligencer, July 3.) Mr. Curtis, Major Lally, and Waddy Thompson, are interested as counsel, and Beo- retary Corwin, as well as Mr. Corcoran, are said to have alarge share in them. It is understood that District Attorney Fendall after eabinet council, is sutho- rized to prosecute the matter, Gardiner has gone to Europe It is underrtood that Mr. Port, the eelebrated Puebla tobaeco dealer, discovered the Gardiner fraud, and by Edward Curtis it was communicated to the government.
